Hate crimes will not be tolerated: NPA

Cape Town - The National Prosecuting Authority said the sentence of the four men, convicted of stabbing and stoning 19-year-old lesbian Zoliswa Nkonyana to death, sent a strong message that hate crimes will not be tolerated.

Four men were jailed for 18 years each by a Cape Town court on Wednesday for stabbing and stoning Nkonyana to death in 2006.

Magistrate Raadiyah Wathen sentenced Lubabalo Ntlabathi, Sicelo Mase, Luyanda Londzi, and Mbulelo Damba in the Khayelitsha Regional Court to 18 years each. Four years of their sentences were suspended for five years.

A crowd outside the court cheered, sang, raised their fists and danced when news came that the men had been sentenced.

National Prosecuting Authority spokesperson Eric Ntabazalila said the sentence sent a strong message that hate crimes would not be tolerated.

No remorse

"We are happy that the court agreed with us that these gentlemen did not show any remorse and had a slim chance of being rehabilitated," he said.

Nkonyana's stepfather, Gladwell Mandini, 45, said: "They did not accept responsibility for what they did and we are happy that when we asked for a lengthy jail term, she [the magistrate] agreed to that."

He said the long court case that saw numerous postponements had been an ordeal for the family.

"It wasn't easy all these times the case was postponed. As the family we have accepted this, but the loss we will not forget."

Jayne Arnoff, a director of the gay and lesbian organisation Triangle Project, said they were satisfied with the sentencing.

"The magistrate said Zoliswa had a right to live openly as a lesbian because that was her own choice," she said.

"She sent out a strong message that we are a diverse society and that we must respect each other's diversity."

      Nope should be death penalty! Sweet and simple. No more worrying after five years they get back on the street to kill again! Our tax money not spent to keep them fed and alive so they can vote for a useless President who makes sure they get their voting poles at the prisons. Where have you ever heard that? I think we need a new Party with all races that have a bigger and better prospects for our nation!

    As much as we do not condone the act but we can't help wondering if also the blame can't be placed squarly on the hands of the gays and lesbian communities. So far I have not seen any outreach programme for gays and lesbians in our communities. This thing is new to our people and a proper measure of intergrating them with the community needs to be done or else this will continue happening! I wonder if these reactionary judges considered that or just judged out of anger!

    Over 5 years of delays in the courts and only 18 years in jail does not send a message never mind a strong message to anyone. Justice should be swift and appropriate. In this case 4 men against 1 woman is a very 1 sided fight. N.P.A. Rethink your outlook.

    Mpumi makes a point I have pondered myself. I, in no way entertain the notion that these perps could in anyway be condoned. All I am saying is that there has been a "Closet Exodus", if you want, of lesbians and gays in the townships where I live, Khaya, Nyanga, Gugs Langa etc. The girls and boys congregate sometimes in places where everybody is supposed to enjoy themselves openly. But it appears that some people still hold dubious opinions, or might still be confused about the issue of sexual liberation. This, I think, places vulnerable groups amongst us in danger. At times I found myself creanging at the interactions between the straight and the queer. The situation from my stand point is not yet conducive for free love.

    Gee, the power of words amazes me! 18 years with 4 suspended, down to 14, then comes early release maybe and the NPA crows on about this being a strong sentence. Is it, surely not, and therin lies a serious problem. If the authorities believe that this sentence sends a really strong message then they consider human life to be worth very little

If three straight guys beat up a gay guy, is that a hate crime? If three gay guys beat up a straight guy, is that a hate crime? If white guys break into a black guys house, beat and rob him is that a hate crime? If blacks break into a white person home, beat and rob them is this hate crime? Thousands of farmers have been robbed, tortured, raped, beaten and murdered. Are these not hate crimes? Surly all crime is hatred.
