Jub Jub crashed into kerb - witness

Johannesburg - Musician Molemo "Jub Jub" Maarohanye crashed into a kerb to avoid a collision on 8 March 2010, a witness told the Protea Magistrate's Court on Wednesday.

Maarohanye and his co-accused Themba Tshabalala are accused of ploughing into a group of schoolchildren while drag racing along Mdlalose Drive in Soweto.

Four children were killed and two others were seriously injured.

Benjamin Maseko told the court that Tshabalala was trying to overtake Maarohanye on that day, causing him to crash into a kerb.

"The blue car hit the grey car [Maarohanye's car]. I say this because the blue car was the one that recklessly appeared behind it and swerved towards it," Maseko told the court.

Maseko had been transporting schoolchildren in a kombi that day.

Under cross-examination, Maseko said he did not see the actual accident.

"I saw the collision, but the point of impact I didn't see."

Maarohanye and Tshabalala face four counts of murder, two of attempted murder, and reckless and negligent driving while under the influence of alcohol and drugs.

      i think what they trying to say is he saw the blue car hit the grey car but nothing after that, doesnt matter these guys were racing and both are guilty in my eyes i dont care who hit who or what overtook what, its imaterial they where the cause of these 4 deaths "PUNISH THEM ALREADY"

      Scenario: you drive a car, see two cars approaching you at high speed, one trying to overtake and both collide. you take evasive action, hit the curb and try to manage your own vehicle with 12 children on board,the impact of the cars will be well behind you when it happens, you do not look back as you are still busy managing your car in a light state of shock. Anybody involved in an accident will acknowledge that remembering the details afterwards could be difficult.

      @procold2 - well thank god the courts are there to get to the bottom of things instead of relying on sensationalist media coverage to condemn someone without the full array of facts. im not saying jub jub is not guilty, but im not saying he is either. let the courts decide.

    Here's a scenario: I'm driving along the road and suddenly I see a car speeding toward me on my side of the road. Instead of just taking evasive action there and then and focusing on my own driving, bearing in mind I have 12 kids in the car, I have time to take note that the one car hits the other car?

    first, this case is going to fall because the prosecutor opted to charge them with murder first instead of culpable homicide or manslaughter. To commit murder a person has to have intention to kill, not forseability. In this case, Jub Jub and Themba never meant to cause the death of the kids, but it happened due to unforseen circumstances

    How long are they going to drag this thing out..... Surely there must be enough evidence to convict. Would have thought the fact that they hit the kids and were under the influence was about enough
