Judge: Raped child failed by parents, authorities

Pretoria - A Pretoria high court judge says an 11-year-old rape victim was dismally failed by both her parents and authorities.
 
On top of that, the magistrate presiding over the trial told the frightened child in the witness box that if she did not tell the truth he would punish her, the Pretoria News reported on Tuesday.

North Gauteng High Court Judge Tatu Makgoka was hearing an appeal by the little girl’s rape accused to have his conviction overturned.

While Makgoka granted the appeal, his stated in his finding that it was possible that the man had raped the child on previous occasions.

The little girl claimed she had been anally raped on 14 April 2011. When she was taken to a doctor the next day, he did not find fresh injuries but he said it was clear that she had been penetrated on previous occasions.

The girl said on the night of the claimed rape, she was playing in the street when the man grabbed her, took her to his home, and violated her. She did not go back home afterwards as her parents were constantly fighting, she said.

She grabbed a blanket from her uncle’s washing line and slept outside his shack.

Judge Makgoka said the child was clearly neglected and ordered Social Services to investigate her situation.
