Killer taxi driver wants bail reinstated

Cape Town - Minibus taxi driver Jacob Humphreys, who was found guilty of murdering 10 children this week, will apply to the Western Cape High Court to have his bail reinstated, the National Prosecuting Authority said on Wednesday.

NPA Western Cape spokesperson Eric Ntabazalila said the authority received notice that Humphreys' legal team intended to apply to have his bail reinstated on Thursday.

"We are going to oppose that application," Ntabazalila said.

"We believe he is supposed to be behind bars until he is sentenced." Humphreys was found guilty on Monday of murdering 10 school pupils who died after his minibus was hit by a train at a level crossing at Blackheath outside Cape Town on August 25 last year.

Western Cape High Court Judge Robert Henney on Monday also found Humphreys, 55, guilty on four charges of attempted murder.

The incident happened after Humphreys stopped at the Buttskop level crossing in Blackheath, overtook a row of cars, ignored safety signals and proceeded though the crossing.

A train hit the taxi and 10 of the children died. Four other children were seriously injured.

Henney said he could not think of a better example of a person being able to foresee the consequences of their actions when he zig-zagged through the level crossing.

Humphreys had his R20 000 bail revoked and was taken into custody after the verdict.

He will be sentenced in February next year.

      Not once has he shown remorse. He states he doesn't remember what happened. Witnesses have testified that he ran that crossing many times in the past. Why should we show him mercy? Reptition of something is not a mistake, it is ignorance and tempting fate. He must have known that something would happen eventually.

      @ Yaseen, too many people are killed due to the disregard of the rules of the road. We must start to do something. As long as "visible policing" is a oxymoron in this country, the carnage on our roads will continue, and maybe the courts will help change that. If t was my children, I would want some sort of justice. It won't bring them back, but it will maybe help a little bit?

      The sooner you start the sooner you'll be out again. The 2 months until February will form part of your jail time. A pity that sentences run concurrent. Kill one child and sit in jail for 15 years. What about the other 9 children. He will probably be sentenced for 150 years but serves only the first 15. He should do community service for the rest of his live after he did his 15 years and if he mess-up again he do the next 15 years in jail.

      LOL, the sentences to be announced in February will most likely run concurrently and he’ll be out after 25 or even 20 years for good behaviour.

      is life imprisonment not 20 instead of your 25? Also you can never confirm what these judges can decide,he might just say these years run concurrently! but i hope for a lengthy sentence as well, to teach these irresponsible guys who drive recklessly.How about th same sentence for taxi drivers though.Amazing how taxi drivers survive these horrific scences hey!

    It's not like the will find him not guilty should he appeal. Let him start paying his debt back to society now. Why should he be able to spend Christmas with his family while the victims families will never be able spend time with the children he killed.

    why wait till February for sentencing....guilty as charged so let him start serving his time....he has prematurely sentenced 10 kids to death with his actions and almost killed 4 more....10 x death penalty for him

    Grant him his bail on condition that he on Christmas Day, Boxing Day, New Year's Eve and New Year's day visit the parents of the children he murdered and maimed.To add a little bonus make him, while out on bail, daily clean ambulances returning with victims of traffic accidents.

    This is not arrogance but sheer callousness. Some of these taxi drivers have no heart and play Russian roulette with passenger’s lives all because they want to inch ahead faster to beat a competitor and make an extra buck. He deserves not just to stay in prison till the sentencing but also stiff sentence. The court system is too lenient with people who break driving laws and this puts everyone at risk.

    He's been found guilty so I seriously doubt they'll let him out, too much of a flight risk. On the matter of sentencing lets just hope they throw the book at him. Even if they can only give him a max of 25years.

    We read of a lot of cases where the court case is delayed for some reason. Why don't we ask for a new law: If the man is guilty and his appeal fails, put his legal counsel in jail with him for the amount of days wasted. I think legal counsel are the main source of delays in carrying out sentencing, let's speed that up!

    I can't believe the hysteria on this thread. Humphres was not on a suicide mission intending to kill a whole lot of kids. He was a typical black taxi driver who came unstuck. The charge should have been culpable homicide and the sentence 5 years.
