Man held for drinking killed in cell

Cape Town - A man who had been locked up in a holding cell after he was caught drinking in public, was killed by two men during a fight in their cell in the night, a court has heard.

The Cape Argus reported that Daniel Dyosi, 40, and Sipho Mhlanga, 33, had been locked up at the Durbanville police station for drinking in public on 21 April.

When airport freight clerk Eben Meyer was brought to their cell a few hours later, he allegedly started attacking them.

“When I woke up, (Meyer) started assaulting me,” Mhlanga testified.

“[Meyer] said a number of things, like we are kaffirs and not allowed to sleep there. We allowed him to assault us for 30 minutes and then we became tired and fought back.

“After we assaulted [him], [Meyer] apologised and [Dyosi] gave him a blanket and then we slept.”

But at about 04:00, police discovered that Meyer had died.

The State said it was in possession of witness statements that told how Meyer’s head was bashed against the wall and on the concrete floor during the fight.

Dyosi and Mhlanga were charged with murder.

Both men have requested to be released on bail to look after their children and find new jobs.

      The authorities probably stood by and watched it.There is so much more of this but its coverd up.I was locked up infront of my kids just for asking two SAP Members why they were visiting my nabour while they should be on duty???

    So this guy gets locked up, starts swearing at and beating 2 thugs (which they let him do for 30 minutes), then the 2 guys politely beat him in retaliation and gave him a blanket. Maybe he fell out of bed during the night, crushing his skull. Sounds true to me. He obviously deserved it...

    @Jackie.stone.501 It is not to say that he used that word as it is the two men whom assaulted and killed him's word against a man whom will never speak again whom should have been in the care of the state and they let us as society down again by letting another person die in their care. This has happened so many times and you only hear some of it not all the cases. And then why is the officers on duty also not charged, they should be checking in on the prisoners at least once an hour(according to the rule book). I am disgusted by what is going on in OUR country, you should go out to the out lying towns Strand, Paarl ect. and go and sit in on hearings in the magistrate courts and then you will know that there is a hell of a lot going on you never hear.

    Both sides of the story. The other dude is dead. There is not going to be any side from the story. The police where in John Vorster Square. Actually, I more than suspect that the victim fell when he stepped on a bar of soap. Or maybe he accidentally hit his head against the urinal when he was puking. Either way, let us leave this matter to our ever so efficient justice system.

    Well I can confirm one thing, this is not 1st time this has happened a couple of years back my wife's nephew was also held in a cell in the Harare police station in Khayelitsha for exactly the same reason and was killed, the case was thrown out of court for no concrete reason, so all of this does not surprise me.All we(South Africans) have to do is stand up together no matter what colour we are and fight against these sort of things, because listen no matter what colour you are this ish affects you too.

      Durbanville cops are the MOST INCOMPETENT BUNCH OF TWATS in the SAPS. They are incapable of doing any police work other than filing vehicle accident reports which is stretching their abilities. I won't even have documents stamped there.

    He was caught walking under the influence, thereby putting other innocent people's lives at risk. I don't agree to the way he received the punishment, but he deserved to be taken off the road forever and these two guys finalized the sentence. Now they must also pay up for their deeds. Maybe the warning will be clear not to use the road as drunk pedestrians

    Good old SAPS. Surely when you lock a psychotic rapist, a murderer, an armed robber, a thief and a public drinker in the same cell who are ALL innocent until proven guilty YOU, the SAPS have a contratual obligation to keep all safe until you bring them before a magistrate. Let us face it people, WE need to straighten out our SERVANT the SAPS.

    Why would 2 men allow one person to assault them for 30 minutes. It doesn't make sense. And it's so easy now for them to say that they were called the k word. Do they think this is going to give them a lighter sentence?

    The video footage of the man taken outside the bar, shows him to be unable to even stand. Yet he was able just an hour or so later to have sobered enough to be able to not only stand, but to attack two people for thirty minutes. I think the defendants story is absolute tosh. May they rot for it!!

    This is shocking.The police officers on duty should be disciplined for not doing their jobs properly.Things would have been different if the good ones were on duty.No lessons are learned because this seems to become a regular thing.
