Man in court for killing Midrand joggers

Pretoria - A man accused of killing five joggers when he crashed into them while driving in an intoxicated state, appeared in the Pretoria Magistrate's Court on Monday.

Sibusiso Langa, 44, faces five charges of murder, one of attempted murder and one of drunken driving.

Proceedings against Langa, who was wearing a pin-striped suit and who hails from Cosmosdal near Midrand, were postponed to Friday.

He was allegedly drunk when he ran the runners over on Saturday morning.

Four women and a man were killed in the accident. Another man was taken to a nearby hospital with critical injuries.

The runners were preparing for the Soweto Marathon when they were hit by the Mercedes-Benz ML500.

      At this age, you would think this man would know better. Really sad that someone can be drunk at that time of the morning and destroy the dreams of people who obviously tried as hard as possible to lead a healthy lifestyle. May they all RIP and may their fellow-runner make a full recovery! :( This man clearly is a menace on the roads and should NEVER be allowed to drive again!

      Firstly in the article it states that they have charged him with murder. Second they would most likely charge him for both murder and in the alternative culpable homicide. Anything and everything that he can be charged with, he will be charged (or has already been in this instance) with. It is a rule of criminal procedure.

      At Wendy. One can actually prove that he had intent. Firstly, when starting out to drive his vehicle to the destination where he consumed alcohol, he was probably sober. His intentions were to go to a point and consume alcohol, KNOWING he had to return to his home or wherever else and that he would probably be the DRIVER, and would have to DRIVE the motor vehicle. So, arriving at his destination, he had INTENT to drink. He consumed alcohol, KNOWING he has to DRIVE his MOTOR VEHICLE back. After that, in his incapacitated condition, still chose to get into his motor vehicle, KNOWING he is going to start the vehicle and DRIVE, which he did. At this stage, he was still driving with INTENT, KNOWING that in the state he is, he can KILL somebody, which he subsequently did. That is sufficient to prosecute him for murder. It is time that the criminal procedure act is changed too to make crimes like this more severe, especially when driving under the influence of alcohol or any other intoxicating substance.Good example. Would one get away with murder by shooting somebody with a gun when under the influence of alcohol? I doubt it very much.Condolences to the families of the deceased. Let us hope that the minister will also visit the bereaved families.

    murder would be an appropriate charge, if I recall "intent" could be defined as dolus directus (direct intent eg plan to murder), dolus indirectus (plan to murder one and second gets killed?) and dolus eventualis - where basically you have foresight that something might happen but you ignore this and go ahead anyway) .....the last one fits nicely with drunk driving....you get drunk knowing that you will have to drive home and may injure someone, but you ignore this and go ahead and drink and drive anyway....this is murder.....

      Dolus eventualis also won't stick cdobo69 because there is an element of subjective intent required, this is a typical case of culpa, you can research the requirements further to see the necessary proof required to sustain that charge. Even though there will five counts of culpable homicide, the sentence will be severe because of aggravating factors....driving under the influence resulting in the death of other.     I suppose the journalist who wrote this article allegedly passed high school. It states the driver drove into the joggers and allegedly killed them. How do five people allegedly die? It's pretty hard fact that they were killed. It should read "The man who allegedly drove into six joggers, killing five of them". Anyway it just goes to show the over use of the annoying word “allegedly” to CYA.

    Most runners run early in the morning and to think that the roads at that time are not busy and yet he still managed to hit runners. He must have surely been all over the road. Shame, they must have been hit from behind otherwise they would have seen the car driving all over the place. VERY SAD AND VERY IRRISPONSIBLE.

      Does it really matter who the hell this guy is? Five lives lost and one in a critical condition. So lets PRAY the surviving jogger survives.     Nobody cares about the race of the people who were killed by this man and almost everyone who has expressed outrage and demanded death penalty forget that this man too probably had a family. Confiscating all he owns and distributing it among the families of those so tragically killed will not bring back those they loved and lost. Removing him from society permanently including his friends and family for the rest of his life is a fairer punishment because he will suffer the loss of all he took from those 5 possibly 6 families as long as he is alive. He may have been a criminal already that has bought his way out in the past. This time he MUST pay with forfeiting his luxury lifestyle to which he was not entitled to to start with and too immature to handle. Don't punish his family except by ruling that he is now dead to them. No parole ever. Make him work to earn his keep by building new prisons for people like himself for the rest of his miserable life and don't exonerate because he is a first offender either.
