Man kills robber armed with BB gun

Mbombela - A 70-year-old Mpumalanga pensioner has shot dead a robber who tried to gain entry into his house with a plastic air gun.

Corrie Potgieter, who lives on a farm near Karino, west of Mbombela, heard his gardener, Fana Mashalela, talking to someone outside the house at about 07:30 on Thursday morning.

He peeped out the bedroom window and saw two men standing with Mashalela. He went to fetch his shotgun from the safe and walked to the bedroom window.

The men were gone but he became suspicious when he saw Mashalela on his knees on the veranda.

The next moment one of the robbers jumped up from underneath the window sill and pointed a pistol at Potgieter.

Potgieter fired a shot which hit the robber in the face. He died on the scene.

When police arrived, they found a plastic pistol (BB gun) next to his body.

Police spokesperson Sergeant Gerald Sedibe said Mashalela had told him there were three would-be robbers. The other two had run away.

The attack was one of several armed incidents on smallholdings around Mbombela over the past few weeks.

The areas hit the worst were Karino, Hermansburg, Cairn, Cromdale, The Rest and Alkmaar, said Vernon Lancaster of Hi Tech Security in Mbombela.

      Philemon, what exactly did you want the farmer to do? Will you please elaborate on that. The farmer looked into the barrel of a gun, albeit a plastic one, and got the first shot in. Do you suggest that we ask the thugs whether their guns are real - you know, like a debate on the stoep? Give us your goodly insight into what you think should be done when you stare death in the face. My sons had BB guns, they looked absolutely real. Still, i want to hear your suggestions. Would appreciate.

      charged perhaps, but the charges CAN be dropped pending an investigation. Should the charges not be dropped, the justice system will evaluate murderous intent, which they will not be able to prove, as it was a bb gun, and he was defending his life?

      @GogsLombard: That is NOT TRUE!!! The Law DOES NOT stipulate any such thing. There is NO REQUIREMENT IN LAW for ANY CHARGES TO BE BROUGHT AGAINST THE LAW ABIDING, LEGALLY ARMED SENIOR CITIZEN. The Police must open an INQUEST DOCKET, NOTHING MORE. Then, if the investigation proves the need, the Public Prosecutor can instruct the Police to formulate further charges.

Any person who kills someone else, deliberately, unintentianlly or in self defense will, at the very least, be charged automatically with culpable homicide and worst, murder. However, that does not mean to say that the case will actually go though as once investigations start and it can be proven (in this case) that the farmer acted in self-defense and used the minimal force necessary to protect himself it will be up to the prosecutor to strike the case from the roll. Charging a person after someone has died is standard operating procedures of the South African Police Force as stipulated by the law.

      Sh*t, Archie - you can shout loud, hey! I'm no lawyer, but he has to be "charged" with something, otherwise the case cannot be investigated. There is no housebreaking, (as far we know) no intimidation, trespassing - yes, but the perp is no longer able to answer charges! The message will get out to other crims, they won't be back.

The fact that the Police are doing it does not make it correct or legal. And which case are you talking about please? There should be an INQUEST DOCKET OPENED. Investigated and sent to prosecutor. Based on investigation docket is closed OR SAPF advised to draw up charges against the victim (if the shooting was dubious) The Investigating Detective should do his work correctly in the first place. "The message will get out to other crims, they won't be back." This I will agree with BUT the other message that SAPS is illegally promoting is "do not use your firearms as WE WILL CHARGE YOU."       I agree that he had to defend himself. He wasn't likely to die if shot with a BB gun though. Philemon, explain to me me what one should do when faced with someone pointing what looks like a real gun at one. Should one wait for the first shot to see if it's going to hurt?       @Slaw In the past week two old people have been attacked by criminals in my neighborhood and in both cases the attackers didn't have guns. In the first attack a woman was badly beaten with a hammer, and the second a old man stabbed with a knife. If criminals can't get their hands on guns then they resort to other deadly weapons.       A case will be opened because that is the law. However, the police will have to decide whether to proceed and in all likelihood, they won't as it is a clear case of justified self defence. Just following procedure.

      Kevin, the shotgun should NOT be taken in for ballistic tests as there is no contention that it was used to rid the world one the criminal scum. There is no procedure on the Police system that stipulates that. The investigating detective must submit his report correctly and ensure ONLY AN INQUEST DOCKET IS OPENED.
