Man suing Eskom has case scrapped

Johannesburg - A North West man who attempted to sue Eskom for R250m for allegedly preventing power cuts through his own prayers may have ended up having to pay Eskom's legal costs.

Beeld reported on Friday that the case, which was listed on the North West High Court roll on Thursday, was scrapped because the court paper did not meet the legal requirements.

According to the report, it appeared that Nelson Thabo Modupe listed himself as the person to be sued, which could have meant that he would be responsible for paying Eskom's legal costs.

The court registrar told Beeld that Modupe was free to sue Eskom again, but his documents had to be in order. He advised Modupe to use a lawyer to assist in the drafting of complex court documents.

Modupe reportedly applied for legal aid in 2010, but this was denied.

Modupe claimed that he had prevented power cuts during the 2010 Soccer World Cup through his prayers, and as a result, Eskom owes him R250m because he saved the power utility the burden and humiliation of load shedding.
