Maqubela challenges statement admissibility

Cape Town - The wife of slain acting judge Patrick Maqubela and her co-accused are challenging the admissibility of their statements to the police, it was reported on Thursday.

The Cape Times reported that Thandi Maqubela and businessman Vela Mabena would go ahead with trials-within-a-trial to fight their statements being admitted as evidence.

The Johannesburg widow and Mabena are on trial for the murder of Maqubela in June 2009.

It was the State's case that an 80cm long piece of cling wrap was used to suffocate Maqubela, and was then discarded in a bin in the main bedroom of his flat.

The State searched for the lost cling wrap for two weeks, but found it and brought it to court on Wednesday.

According to the report, the trial would resume on October 8 in the Western Cape High Court.

The trial had been held at the Cape Town Labour Court because several of the judge's colleagues were expected to be called as State witnesses. However, the court could no longer accommodate the trial.
