'Marikana commission must be inclusive'

Johannesburg - The Marikana Commission of Inquiry must be inclusive and responsive, the SA Human Right Commission says.

Spokesperson Isaac Mangena said the SAHRC was concerned at the withdrawal of five parties from the inquiry.

"The SAHRC and Centre for Applied Legal Studies respect the decisions of those parties and share their concerns at the absence of state-funding for the injured and arrested individuals of the Marikana tragedy."

The commission called on the government to make funds available to the parties to enable their continued participation in the commission process.

The North Gauteng High Court in Pretoria on Thursday dismissed an application for the state to fund legal representation for the victims of the Marikana shootings.

Dali Mpofu, acting for the wounded and arrested Marikana miners at the inquiry hearings, brought the urgent application for the state to fund their legal representation.

He wanted President Jacob Zuma and Justice Minister Jeff Radebe to approve state payment of the mineworkers' legal team.

Mangena said: "While the court has decided that the state has no obligation to fund the injured and arrested parties, it remains the case that the state and Legal Aid have the discretion to do so."

He said it was fundamental to the national interest that those responsible for the 16 August massacre were held accountable.

The commission is investigating the deaths of 34 striking mineworkers, shot by police at Marikana in North West on 16 August last year and the deaths of 10 people in strike-related violence the previous week.
