Mentally challenged teen raped

Johannesburg - A man has been arrested for raping a 19-year-old mentally challenged woman in Butterworth, Eastern Cape police said on Friday.

He was apprehended on Thursday, Captain Jackson Manatha said.

The 26-year-old man went to the woman's homestead on Tuesday and convinced her to go with him to his home.

"It is alleged [that] he raped the woman for the duration of the night and released her on Wednesday morning," said Manatha.

She later informed her relatives, and they alerted authorities.

He is due to appear in the Butterworth Magistrate's Court on Monday.

    What l want to know is what does the law say about having a romantic relationship with a mentally challenged person. Do these people have a right to love. If they have, who can prove whether the mentally challenged person was raped or there was an existing relationship.

      The last I heard (depending, I guess, on the severity of the mental challenge) people with mental disabilities are classed in the same way as minors, ie. unable to give informed consent and therefore vulnerable. It seems highly unlikely that a (for want of a better word) normal person would have much romantic interest in a mentally challenged individual, therefore such relationships seem predatory in nature in the same way a 35 year old man and a 14 year old don't really have an equal standing in a relationship.

      @michelle, thanx for the input. But what about those men and women in a marriage but mentally challenged? Does this mean their partners are raping them each tym they sleep with them. This is becoz rape can either take place between people with relationship or without relationship

      @ James, don't be emotional l am just trying to understand the legal standing of the issue. Emotions don't win cases in a court. It is about what the law says. A lot of immoral criminals are out of jail becoz of what the law say. This is the truth!

      No, lskosana3, sadly the abuse of mentally challenged women has been around for a very long time - what is new is it being reported in the media. I agree with you that parents need to pay attention to how they raise their sons - however many children are not raised by their parents and father's especially are absent.

    The only way to stop this from happening is to treat these 'people' as inhumanely as they treat their victims. Make an example out of them, then the rest will start doubting their actions.
