Mogale City ignores court order - report

Johannesburg - Quill Associates have been declined access to the Mogale City municipality to remove its software following a court order, The Star reported on Tuesday.

In October, the Supreme Court of Appeal upheld a lower court's order against the municipality and granted Quill Associates access to the premises to remove its programmes and systems.

The court ruling followed a dispute over the ownership of the IT software.

Quill managing director Danie van Heerden told The Star he went to the municipality's premises on 17 October with his lawyer and the sheriff of the court in Krugersdorp, but was refused entry.

After being allowed in eventually, lawyers told him the municipality intended appealing in the Constitutional Court.

Municipal spokesperson Nkosana Zali told the newspaper it was considering options available to it but no mention was made about approaching the Constitutional Court.

The newspaper also reported that the municipalities of Westonaria and Randfontein faced a lawsuit of more than R5m each for the alleged theft of IT software.

Quill Associates filed papers in the High Court in Pretoria in June last year.

The disputed software for both municipalities contained details of residential and commercial properties, and had systems for billing, human resources, payroll, the general ledger, budgeting, expenditure, vehicle registrations, and security information.
