Murder charge after cyclist dies

Johannesburg - The case against a man accused of killing a cyclist in an accident near the Knysna Lagoon was postponed in the local magistrate's court, Western Cape police said on Saturday.

The man appeared on Friday and his case was postponed to July 6, said Captain Bernadine Steyn.

A 21-year-old Malawian cyclist was knocked down on Friday and died on the scene. The accused faced an initial charge of culpable homicide but it was amended to murder.

He was released on bail of R500, said Steyn.

    Condolences to the friends and family. The charge should rather remain culpable homicide. Intent and motive must be proven, to make a charge of murder stick. Unless there were specific other transgressions and/or disregards like in the case of Humphries , dolus eventualis cannot be a consideration, in my view.

    The amount of money bail is set at doesn't really reflect the seriousness of the offence committed but its about subjective factors regarding the accused and his financial means ie what he can afford...

    This article states it was an accident. I understand the term accident is usually associated to an action without any intentions. Therefore the charge of culpable homicide would have been correct. No case of Reckless and negligent driving has been reported opened. The case changed from culpable homicide to murder. If a person is charged with murder does this mean he intended knocking down the cyclist? Why was bail set at only R500 if the case changed from culpable homicide to murder? News 24 doesn't explain the reason for the change in charges but I am assuming that this is what could have happened. The cyclist was on the road and obstructing this motorist which then turned into an argument(road rage) and ended in the motorist running over the cyclist. As I said this is just my assumptions, hopefully once news24 gets an update of events they would publish it. Condolences to the family and friends of the cyclist. I trust that justice will be served.

      Marina, I am genuinely and sincerely sorry for your loss. However, did the driver set out, with malicious intent, to kill Jo? I don't believe so. Does the driver deserve to face charges of culpable homicide? Of course. Is it atrocious that he was released on bail for small change? absolutely. Calling it murder, however, does not make it murder, in fact it simply skews the definition of murder. Does the penalty for such cases of culpable homicide need to be much more severe? Definitely. Calling this act something which it clearly was not, makes no sense at all. The penalty needs to be made more severe, that is all. I understand why the do this in the interim, but sooner or later our legal community has to adjust the penalties rather than assigning fabricated definitions. All it does is make the world see them as kangaroo courts. Once again, sorry for your loss and I too hope justice is served both severely and rapidly.

    The cyclist was my gardener. Cycling on the correct side of the road on his way to work.. The driver of the car was on the opposite side of the road, 4 lanes separating the two. The car driver was speeding in a 60km zone, in heavy rain. He hit a puddle of water at high speed, aqua planed, hit the pavement on his side, shot over 4 lanes to the opposite side and hit my gardener. He traveled +- 8m before he hit the ground. Dead. The case was changed to murder because of reckless driving and the high speed the young man in the car was doing.. My gardener was an exceptionally hard worker, a trustworthy young man, intelligent with his life ahead of him. he was taken away by somebody who in my opinion do not deserve to walk away free.. My hart is still sore. I pray for justice. RIP Jo.

      There are no justice for serious crimes in this country. Only postponement upon postponement. But let it be a petty thing and the harshest punishments will come out. Absolutely pathetic...
