NPA violated Breytenbach's privacy - lawyer

Pretoria - The National Prosecuting Authority violated suspended prosecutor Glynnis Breytenbach's privacy, her lawyer said on Friday.

"You abused the opportunity to violate the confidentiality of her private papers... to rustle up charges against her," Wim Trengove said at her disciplinary hearing in Pretoria.

He was cross-examining William Gloster, internal investigator for the NPA's integrity management unit.

Gloster was the second witness at the hearing at the NPA offices in Silverton.

"When you saw the credit application you immediately knew it had nothing to do with your investigation?" Trengove asked.
Gloster admitted this, but denied he was trying to rustle up charges.

"I did not suggest a charge, I handed it over [to his boss] and said please look at this," Gloster said.

While analysing Breytenbach's e-mails on the NPA server, the integrity unit had found Breytenbach's application for car finance in 2009.

In it she listed under "other income" that she earned R4 000 a month for renting out a flat and stabling a horse.

Earlier, Trengove called the reading of this e-mail an abuse of Breytenbach's constitutional right to privacy of her communication.

The hearing will continue on 6 August.

      IF William Gloster and the other 'useful witness' Wasseman had access to the NPA Server and abused this access to 'Target and Vilify' one of their own (innocent??) ::} ... this opens up a totally different set of circumstances .... Would these 'useful' employees also go to the OTHER extreme ?? ... To abuse their access to the NPA Server and provide accused (criminal) persons with highly sensitive information ??

      I hope you dont understand what you stand for, the law enforcement is to combact crime under darkness, if isnt the case all criminals are violeted their rights, NPA has no ways to employ somebody like this woman who does nt declare her other financial source of income The woman has to be removed from the NPA she is nt loyal and trustworthy

      Just yesterday Madonsela was acused as a member of opostion party now her dept has zero credibility ! If Mrs B was a senior member of NPA what made her spy others ? Sure she knew proper procedures and decidea to half follow them ! She had her own agenda full stop.

    It seems that every statement made, every step taken, every "corrective" action taken just makes more of a mockery of government. It's becoming more and more apparent that do not know what they are doing and also do not have the wisdom to know the result of their actions. Let the ball roll. And when it reaches the pothole it will finally destroy itself. Trying to patch the pothole won't work, it just comes back - each time it just gets bigger.

    Another cover up of a cover up. NPA stands for No Punks Allowed. We are a bunch of wannabee lawyers with our heads right up our asses. Another version of NPA is No People Allowed. The should be the TWSFC; those who stand for corruption. Get your heads out of your asses, take a deep breath and say, "what the hell am I doing here?"
