No photographs of Modimolle accused

Modimolle - The Modimolle Magistrate's Court ruled on Friday that no photographs may be taken of the four men accused of torturing and raping a woman.

"I hereby issue an order that no photos, still or moving, may be taken inside court of the accused by the media or public," Magistrate Hannes Stoffberg said.

"This doesn't mean notes can't be taken."

Johan Kotze, Andries Sithole, Peter Mohlako and Sello Frans Mphaka are accused of torturing and raping Kotze's estranged wife Ina Bonette in January this year. This was the first time the four appeared in court together.

Kotze had hired the three men to work in the garden of his rented home in Modimolle. On January 3 he allegedly forced them at gunpoint to rape and mutilate her with objects including nails, a screwdriver, and an angle-grinder. Kotze also lured his stepson, Conrad, to the house and allegedly shot and killed him.

Conrad's father, grandfather, aunt and uncle sat in the front row of the packed public gallery. A neatly-shaven Kotze sat in the dock, wearing a yellow checked shirt, blue jeans and jacket.

The public gallery of the court was packed ahead of the case.

A small group of ANC Women's League members stood quietly outside the court holding posters that read "no bail for murderers and rapists".

Kotze previously chose not to apply for bail. His co-accused were denied bail after they failed to prove there were exceptional circumstances justifying their release.

    Keep them in jail from now until eternity. Ina, you have to be one of the strongest women I have ever heard about to be able to survive your son's murder and all their evil deeds with some semblance of normality. Respect.

    Sad for the other 3 men whom according to the victim were forced at Gunpoint to complete these ghastly acts .......Now we are supposed to forget these statements and allow these victims to be tried as Perpetrators..............Judicial circus.

      @Tamaranui - even if they were held at gunpoint (3 to 1) it appears that they still managed to rape her which makes them perpetrators in my opinion. You can take a horse to water but you cannot make it drink - even if you hold a gun to its head.

      @Tamaranui - Don't have one of those appendages but find it difficult to believe that the male brain has no control over the phallus. My brain certainly has full control over my libido. @Rob - Did you miss the point of the adage? Personally think that anyone who can do that to a human is not a human, whether they have a gun at their heads or not.

      @Marion - Here's a conundrum for you, suppose I come up to you and told you that if you don't rape and kill your husband, I would rape and kill your daughter.... What would you do?? If it is true that these men were held at gunpoint and told to perform these atrocities, should these men have rather taken a bullet each instead of trying to save their own lives? If you answer yes, then should a hijack victim rather try and run or fight than give up his vehicle? It is easy to condemn those that cannot muster the courage to stand up for themselves but if you look around, you will notice that most people on this planet are afraid and will protect themselves before the person next to them and rightly so, it is a genetic disposition to put oneself out of harms way.

      @Rob - your conundrum is not in quite the same ballpark as their situation. Give me a more realistic one because to be quite honest I would happily rape my husband to save my daughter's life. A woman recently strangled her child because her boyfriend allegedly held a gun to her head. In Russia a few years back a woman in a hostage situation at a school was given the choice to remove only one of her two daughters from the school. She removed one. Then she went back into the school and died with the other one. Yes, people react very differently in many situations. Insofar as the car goes, I would run to save myself and let them take the car. That is why we have car insurance. About five years ago a virile young guy was assaulting his wife in a shopping centre in Kensington. He had her down on the ground and he was beating her and she was screaming blue murder. Everyone, including men, just stood watching the scene. I stepped in to stop him and got a fat klap and head butt for my trouble but I would do the same again. Don't think I wasn't scared. I was bloody terrified 'cos that guy is related to a mafia type who 'owned' the centre and many of the cops in the area. I do not live by a philosophy that says 'bugger you Jack, I'm alright' and turn a blind eye to things that are blatantly wrong in our society so that is probably why I cannot understand why others take the 'easy' way out. Or maybe I just have a death wish.

    Hired three men to work in their garden. So had a gun at all times on these three "men", If I was a man, i would have fought this Kotze dude when he was pointing a gun at the other man. I would not have raped a woman...these guys are talking abosolute bul*s*it to try and get lighter senetences.Hang them all!!
