Phakoe's killers get 20 years behind bars

Rustenburg - Former Rustenburg mayor Matthew Wolmarans was jailed for 20 years on Tuesday for the murder of whistleblower councillor Moss Phakoe.

The Rustenburg Magistrate's Court sentenced his former bodyguard Enoch Mtshaba to life in prison.
Handing down sentence, Judge Ronnie Hendricks said the two did not show remorse.

"Accused no. 1 (Mtshaba), regarding your personal circumstances they are no reason for this court not to hand down the prescribed minimum sentence," said Hendricks.

"Accused no. 2 (Wolmarans) your personal circumstances differ. Your wife was diagnosed with cancer and you have two children aged 10 and 13 that depend on you, and also you support your extended family," he said.

Outside court, supporters of Wolmarans ran down the street in front of the court in protest after finding out about the sentence.

Public order police quickly stopped them when they ran in the direction of the municipal offices.

      That Wolmarans is an associate of known criminals and I don't mean ANC here. The fact that this murder stemmed up from a corruption case just tells you. Now bring back the corruption charges and he might as well then he might get another 20 years on top. Job well done to the police.

      20 years for the two unrepentant killers is nothing and this is injustice for the family of the victim. They should each get a life sentence for taking a life. MR Phakoes I honour you for taking a stand against corruption. R.I.P

      eish i dont understand justice systme in south africa, life sentence is 25 years served in full without parole, in the states life sentence is as it sound with no possibility of parole, if a judge hands down a sentence of either 30 yrs, 40 yrs or 60 years for murder & maybe if u lucky will be paroled after serving 20 yrs, 30 yrs or 40 yrs respectively its not regarded as life sentence - whats goin on in this country judicial system life is 25 yrs & after that realesed, am correct?

      What's hard to believe is that you commit murder but you still have supporters. Are these the uneducated unemployed? Do people take time of work to go protest the sentencing of a murderer? Is this a rent-a-crowd?

      You know what Wolmarans should get a LIFE SENTENCE, 20 years my foot, they robbed a father away from his kids I mean Phakoe's children are fatherless and all the judge can say is he has a 10 year old and a 13 year old his wife has cancer so what???????? Why didn't he think of that the day he decided to hire people to kill Moses Phakoe......sis I'm disgusted by this stupid law and government!!!!!

    He thought he was more powerfull than the justice system!Hope they die and rot in jail,they murdered a father a parent and a law abiding citizen,justice has prevailed.Rustenburg citizens including the family of the slain Mr.Phakoe,the investigators who worked tirelessly,the prosecution and the magistrate,you have proven that justice is not always for sale at marked down prices.

    How come one ANC public official after another is either murdered or jailed. ANC people might not like it but the truth is this organisation has been infitrated by criminals disguized as "comrades". I feel sad for Mandela, Sisulu OR Tambo and the rest their successors have betrayed them

It's this sort of insane behaviour that I will never understand, and why we'll never progress to be a united nation with dignity. Too many criminals and people who support criminals.

    the mayor conspires to kill a man and gets just 10years,what'swrong with the magistrate,i mean this criminal is gonna appeal/have have life-threatening disease soon and will be realesed without spending even a single year in jail,you just gave us the reason to take the law into our own hands,poor police who investigated the whole thing from 2009,magistrate is demoralising them.

    Fitting punishment on the part of the former bodyguard, life sentence. Pity the main culprit, only 20 years. He should have given the same sentence as well. It is individuals like these, that make delivery impossible in our communities. They are corrupt and selfish. There are so many hovering around. The arm of the law, will get you one day. Killing an innocent servant of the movement, father and confidant. His crime was to report you. I wished the later, Scelo Shiceko to have actioned this quickly before Moss was maimed.

    Why does it matter that the one has small children? When he gets out they will be 30 and 33 yrs old in any case and most probably criminals as well. That is unless he comes out in a few months time!
