Johannesburg - The NPA sent a letter to prosecutor Glynnis Breytenbach's legal team inviting them to discuss her possible return to work, her lawyer Gerhard Wagenaar said on Tuesday.

"We said we would discuss it with them, but it was not a condition of her return to work."

Wagenaar said he suggested the meeting take place on Friday, but he was still waiting to hear from the National Prosecuting Authority (NPA).

Comment from the NPA could not immediately be obtained.

On Monday, Breytenbach was found not guilty on 15 counts by a disciplinary hearing which sat at the NPA's head office in Pretoria.

A core charge against the anti-graft prosecutor was failing to act impartially when investigating the Kumba Iron Ore/Sishen and Imperial Crown Trading mining rights issue, because of "improper relations" with Sishen's lawyer Mike Hellens.

Breytenbach was also found not guilty on any of the alternative charges. She was suspended from the NPA on 30 April 2012.

On Tuesday the NPA announced it would bring a court challenge against the disciplinary hearing's ruling.

"The findings are factually incorrect and legally unsustainable," NPA spokesperson Nomilo Mpondo said in a statement.
