Reitz Equality Court case settled

2011-02-21 10:22

Bloemfontein - The Equality Court matter between the "Reitz Four" students and the University of the Free State (UFS) workers, in which each worker claimed R1m in damages, has been settled out of court, the Volksblad newspaper reported on Monday.

The UFS is expected to make an announcement on the matter on Monday.

The newspaper said the out of court settlement allegedly includes an agreement that the four former students would make a public apology on television.

The UFS, which was added to the Equality Court proceedings with the students, would also give its apology to the workers at the time.

Agreement

The report said the head of the SA Human Rights Commission in the province, Mothusi Lepheane, who represented the workers, would not comment on the matter but indicated that a final agreement would be reached within the next two days.

On Monday, legal representative for the students, Christo Dippenaar, confirmed that an agreement was reached but could not give detail on the matter.

The charges relate to the students humiliating five black workers in an initiation-type ceremony in 2007, which they filmed while living at the University's now-closed Reitz men's residence.

In papers filed at the court, workers Emmah Koko, Rebecca Adams, Naomi Phororo, Mittah Ntlatseng and David Molete asked that the former students apologise to black women and black people generally, and pay them R1m each.

The former students RC Malherbe, Johnny Roberts, Schalk van der Merwe and Danie Grobler were in July 2009 sentenced to a R20 000 fine each, or 12 months in jail after pleading guilty to a charge of crimen injuria.

They were later granted leave to appeal their sentence, which would be heard in June this year.

      unbeatabulls - 2011-02-21 11:15

hey Daniel, so that means u are one???????

      Thangy - 2011-02-21 13:40

Wow!! where are all the morally upstanding visitors to this website? Those who would fight any atrocity with their gleaming white swords? The ones who cry genocide this genocide that! They are all here telling us how it was all blown out of proportion!! Wonder if the roles were reversed!!

      Thangy - 2011-02-21 13:41

@barryjoelm has even fooled himself into believing he knows how the victims felt, pathetic!

  • peterctew - 2011-02-21 10:56

I wonder what ever happened to the black students who intiated the white students... also on camera and also degrading them... at UFS...

  • Ni-hao - 2011-02-21 10:57

Hey Daniel... Your mother is a racist. Please f off!

  • advurt - 2011-02-21 10:58

And the next time that fat idiot MAL-EMMA opens his pie-hole, I expect a public apology from him too.

  • barryjoelm - 2011-02-21 11:50

The five black workers did not feel humiliated until they were TOLD to feel humiliated by the ANCYL. Whilst I agree that these students are scumbuckets, and there is no place for them in a non-racial society, I think that this whole episode has been blown completely out of proportion. A million Rand each? Get real.

      sceptic - 2011-02-21 13:12

NON RACIAL SOCIETY? WHERE DO YOU LIVE? UTOPIA? LOOK AROUND YOU, YOU MORON. YOU PROBABLY HAVE NEVER LIVED IN BOARDING SCHOOL. INITIATION IS A NORM, AS LONG AS IT DOES NOT INVOLVE VIOLENCE. HAD IT BEEN FIVE WHITE GUYS THAT WERE INITIATED THIS WHOLE EPISODE WOULD HAVE BEEN LAUGHED UPON WITH A CASUAL SMIRK. YET BLACK PEOPLE ARE SOMEHOW HOLIER THAT THOW AND CANNOT MIX ON A SOCIAL LEVEL WITH WHITE PEOPLE BECAUSE THE SLIGHTEST INDICATION OF INFERIORITY IS MISINTERPRETED AS BEING RASCISM. SO I ABSOLUTELY DISAGREE WITH YOUR COMMENTS, RASCISM IS ALIVE AND WELL IN SOCIETY. THESE STUDENTS WERE TRYING TO "BREAK THE ICE" COMMUNICATING WITH THESE WORKERS ON A "FUN" LEVEL AND SOMEONE MISINTERPRETED IT AND THE WHOLE EXCERSIZE WENT SOUR. HAD THIS NOT BEEN MADE PUBLIC, EVERYONE WOULD HAVE GONE ON WITH THEIR DAILY LIVES LIVING IN PEACE AND RESPECTING EACH OTHER, WHICH IS HOW THE WORLD WORKS BY THE WAY, OR SHOULD AT LEAST. I SAY, YOU SHOULD GET REAL AND START LIVING!!

      pediman - 2011-02-21 13:12

@smaal,u realy did not witness any racial slurs or racial abuse on that tape???? ok picture these:lets say the workers are ure parents and sisters and those boys are julias malema and his friends. now tell me were is the fun in all this

      Zion - 2011-02-21 15:29

For a million bucks even I would settle to drink of the libations offered to the workers.

      Maxwell Sokhela - 2011-08-17 18:52

@Sceptic, Initiation is good but there has to be a line, as long as it is not Human degrading, coz honestly making people eat food that is urinated on and video taped it.

  • mikey.kilpatrick - 2011-02-21 11:51

  • Stylin - 2011-02-21 12:07

    - Makes me sick to think there are people who actually think they are superior because of the colour of their skin! and it's not even a nice colour!! - These racist pigs prevented black folk from living peaceful and decent lives. - The worst part is that most of them are still racist, except these days they're not the GROOT BAAS anymore!!!

      advurt - 2011-02-21 12:14

Hey Stylin - sounds to me you have issues dude.Get over yourself.

  • Mpumelelo Maphalala - 2011-02-21 12:35

i reali think those kids should make a public apology ryt here on campus because they disgraced uovs bigtime and be expelled thereafter

  • sceptic - 2011-02-21 13:01

WHERE DOES A STUDENT GET A MILLION RAND? MOST PEOPLE WORK A LIFETIME TO ACCUMULATE EVEN R100 000 OR LESS. WHO'S IDEA WAS IT TO TELL THESE WORKERS TO CLAIM R1 M? THEY DEFINATELY WOULD NOT HAVE DONE SO OUT OF THEIR OWN! MUST HAVE BEEN SOMEONE IN THE ANC, SINCE THEY SEEM TO THINK MONEY GROWS ON TREES AND WHITE PEOPLE HAVE THESE TREES GROWING IN THEIR BACK GARDENS.....

      Thangy - 2011-02-21 14:23

Well thats just bloody good, they'll be working their victims for the rest of their lives, PERFECT punishment!

  • Gazwa - 2011-02-22 08:08

Maybe the White police woman who had her head shaved and had severe sunburn because of it should also claim, and ask for a public apology on TV for her and whites in general too, and the White policeman and the Black policemen who did their duty by stopping a vehicle that was being driven recklessly *AKA* the winnie expressnd should also ask for an apology...the 4 idiots who did what they did , should never have done it in the first place, and the victims should have walkeds away from the temptaion of a lekka dop...period.

  • Meanleader - 2011-03-20 15:24

Boys ! The blatent racist onslaught against whites is so blatent .... where are all those assassins out there ? Complaining doesn't help , court action doesn't help ..... vigilanti's ??
