Pietermaritzburg - A KwaZulu-Natal salesman who pleaded guilty to touching his stepson’s penis with his mouth has been handed a six-year wholly suspended sentence in the regional court.

The stepfather, who initially faced a rape charge for allegedly having performed oral sex on the boy, 7, was convicted of a single count of sexual assault in terms of a plea bargain agreement with the State.

The court was told that the two had established a close bond. The boy had never known his biological father and the two often used to indulge in “tickle-fighting”.

In February this year the accused and the boy were at home. After the boy finished his homework, the accused sat on his stepson’s bed. They then had a “tickle-fight” and the accused pulled down the boy’s pants to his knees. The boy tried to resist and shouted: “No, dad, no”.

The accused thereafter touched the youngster’s penis with his mouth.

The mother, who had just arrived home, walked in on the scene. She screamed and the accused apologised.

He admitted that what he had done amounted to a sexual assault.

The court was informed that the accused has also formed a close relationship with his parents-in-law.

They, as well as his wife, and his stepson, did not want him to be jailed.

The man, his wife, her parents and the boy have all reconciled.

He said he was extremely remorseful and has voluntarily attended a sexual offender programme.
