Top photographer sues over racial slur

Johannesburg - Award-winning photographer Alf Kumalo has taken a man to court for calling him a "bloody kaffir" in a restaurant and threatening to hurt him, according to a report on Monday.

The Star newspaper said the incident happened on January 29 at the Ocean Basket in Sunninghill, Johannesburg.

"This is about history and respect. I have to go through with this," Kumalo reportedly said.

The Star newspaper quoted restaurant manager Romalin Moodley as saying the trouble started when he approached a man in the restaurant to quieten down.

He was apparently shouting profanities while watching the Australian Open.

Moodley said the man continued to be loud and aggressive.

Kumalo approached him and said: "With all this noise, how do you expect us to eat?"

The man then called Kumalo a "bloody kaffir" and threatened to hit him with a wine bottle.

Kumalo laid a charge of crimen injuria and the case was heard in the Randburg Magistrate's Court last week and postponed to March 27 for further investigation.

Kumalo is the curator of the Alf Kumalo Museum and has a photography school in Soweto.

      one thing i must say though, the article does call out the race card holders to start racialy motivated fights. it wasnt an article about "james peterson is taking a drunken man to court for swearing at is 5yr old son" but rather mr kuhmalo is taking loud racist to court...

      The best way I would think would be to get up and leave, or preferably to ask the restaurant manager to sort out his patrons. it cannot be that we get into this mindset of using the law to fight our battles. we are all grown ups, we do unfortunately from time to time face tossers like this, running to the police is simply not an option.

      Jaded, treating people like this is in fact criminal behavior. Deemed so by our constitution. It is an infringement of a person's fundamental rights. Sadly, this behavior will not stop if people aren't made to feel ashamed and punished for doing something unacceptable in society. This man felt that it was acceptable to use this disgusting racial slur, to treat another human being like this. he and the entire country must be shown that this is unacceptable and will not be tolerated in a democratic society.

      Kevin, you are well within your rights to lay a complaint should you wish to. Afriforum took Malema to task for his racist views and behavior. I often wonder if someone would ever try to have BEE declared unconstitutional. Not being eligible for a job because of your color is discrimination, an illegal and direct violation of constitutional rights.

    What makes SA so special that we expect that we have no racists?? People get WAAAaayyy to sensitive when it comes to this subject and it ends up been blown completely out of proportion. Let the man use his legal rights to enforce his right to dignity/respect. As the the accused, if found guilty they should make public who he is and he should face the full brunt of the law, make him go clean up in the townships so he can see the ordeal people do go through in SA.

    Let's see the comments now because when it was the lady in the gym you guys said the insult was justified as she was the instigator by making noise. Shoe is on the other foot now. Well its Bab' Kumalo's right to go through with this and this has to stop! As young as I am I've had more than one of these experiences and it was my white friends that encouraged me to take matters further so I don't ever resent white people in the future because they aren't all the same.

      Absolutely agree. Had same thing happen to me as well; also at Ocean Basket, Waverley, Pretoria. Horrible white jerk, swearing non-stop while chatting to the manager. My asking him to stop, just made it worse. The manager did not utter a sound or lift a finger. Guess what? I've never went back to that restaurant.

    This behaviour cannot be tollerated, but if it is to insinuate that only whites are racist, it is not true. A lot of racist slurs against whites are prevalent in the black community.

Lets face it,during apartheid white kids were taught to be racists by uncles,parents,teachers,the rev at NGK etc.Black families never embarked on an elaborate scheme of imprinting racist views on their kids.However due to the inhuman treatment from whites(in general)during apartheid,some started to resent white south africans,which may be interpreted as black racism.I repeat,non of my friends,family etc grew up with a superiority complex over whites or a general hatred for them.

I hate when I judge an entire race by the actions of a few, but I catch myself doing it - it's a gut reaction and it works both ways. We are still at a sensitive stage when it comes to race and it's soon to tell people to just get over it.

If he had kicked the man out like he deserved this would never have happened. Come to think of it, why is it that fellow patrons seem to think it is right to have loud conversations on their cellphones while sitting next to me?. I am not interested and wish they will keep quiet. Now I do tell them that and some even have enough manners to apologize.     I remember from my days working at Spur how awful Saturday nights could become when there was a Stormers (I live in the WC) or Springbok game on. These idiots would sit around drinking for two hours and screaming at the top of their lungs. An especially unpleasant side-effect of this rugby and drinking is that the waitresses are seen as "extra entertainment". If you can't function in a social setting, you should do the honourable thing and stay home. Besides, the food and drinks bill is usually about the same as a month's DSTV subscription. I don't agree with suing the man, but he definitely deserved to be smacked around and (literally) thrown out of the restaurant. I had the pleasure of using a stun gun on one of these guys one evening. It was the high point of my three-year career as a waiter.

      Agreed. I was at a small Primi Piatti where two youngsters, not even paying customers, were watching rugby. The one in particular, arrogant looking, was shouting at the top of his lungs, huffing and puffing at every move. I left there with a massive headache. I'm fine with people enjoying the match, but there are limits.

      Den, you've missed something over the past 18 years - there is no such thing as a balck racist in SA - it's a one way street. Not that I condone it either way but when last did you read about a fuss when a white has been called a 'white pig'? When a white kills a black it's a racist killing - when a black kills a white it's just plain crime. At the end of the day, murder is murder, it doesn't have to be labelled any other way - and common behaviour is exactly that. Glad though that Alf has taken a stand against the 'white pig'.

    Whilst not condoning the insulting language used by an obviously drunk man, Khumalo should not have got involved. The manager should have got the customer to behave under threat of banning him and calling the police if he got no joy. By the way, none of the trolls at Luthuli house compained when Malema called a reporter a bloody agent and have the police remove him and when he sings 'kill the boare'. Or how about when he said it is not rape if the woman gets taxi fare and breakfast afterwards?

      That's strange because a month ago when that Virgin Active furore was in full force, the white people on news 24 said that lady deserved to be racially abused for shouting "yebo" in a spinning class. Now the white guy is making the noise in a public place and what do you know our white friends say the black guy was looking for attention. I wonder if you can spell hypocrite!!

    I have met this wonderful South Africa icon, and have always found Alf to be helpful, respectful and a complete gentleman.     Timing is quickly fading off for racists who continue to insult balck people in general and Africans in particular. I know what I will do if labelled with such derogatory names - i will go to police to report and surrender myself for what I would have done and not the other way round.
