Rape accused 'visibly shaken' in court

2012-04-20 15:12

Johannesburg - The 37-year-old man accused of kidnapping and raping a mentally challenged Soweto girl appeared briefly in the Roodepoort Magistrates Court on Friday.

Edward Monyela was not asked to plead and his case was postponed to May 4.

The dreadlocked Monyela was warned that the charges he is facing carry the prescribed minimum sentence of life imprisonment.

Asked which language he spoke, a visibly shaken Monyela quietly said “Setswana”.

He said he understood English.

Monyela will apply for bail and has been ordered to hire a lawyer or submit a request for legal aid in the meantime.

I am trying hard to find some sympathy for the visbly shaken accused. And no... I can't even rustle up an ounce of sympathy. I'm more likely to rustle up a pack of rottweilers to visibly shake him up.

      Rupesh - 2012-04-20 16:19

Kala, this man needs to go to jail and be made into someone's b itch. I hope he is repeatedly raped. I know it sounds horrible, but i do hope the biggest nightmare waits for him in jail.

      Kala - 2012-04-20 16:23

I reckon that realisation of what they had done was so wrong that the poor girls screams of mercy would haunt every minute of the rest of their lives would be fitting justice.

      Derek - 2012-04-20 16:24

Consequence - Probably not considered during the brutal attack. I guess however that the thugs will have a very long time to ponder the consequences now that they've been caught. Our thoughts and prayers are with the victim.

      Bibi - 2012-04-20 16:29

@Kala, I agree fully with you. These guys should be locked up to never see the daylight again. I see the dyslexic troll gave you a thumbs down.

      Jack - 2012-04-20 16:32

Why is it that South Africa is regarded as the RAPE CAPITAL of the WORLD? Does it perhaps have something to do with the black culture and their views on women and other races? I can't seem to understand how people can be so barbaric, the whole world and we get to live with the psychopaths. unbelievable!!

      Tinus - 2012-04-20 16:55

Jack That's not a fair comment mate. The 'black culture' as you call it is made up of many sub-cultures. I can also add to this that many horrendous acts are committed within ‘white culture’ communities – abuse, rape, molesting… The problem is that too many whites fear the shame of the world knowing that these things have happened to your loved ones or that some terrible crimes were committed with your own family members on both sides of the act involved. Therefore, if you want to get to the bottom of this your question should be: which sub-cultures are prone to producing monsters, and why.

      Christelle - 2012-04-20 17:49

Visibly shaken - wow, I wonder how he felt when he saw this poor girl who must have been more than "visibly shaken" when being raped. I do not think he should be allowed bail. He knows if found guilty it will probably be for life! Do they honestly think he will not try and dissappear into the system.

      Sam - 2012-04-20 17:51

@Jack, I suspect you are mental ill yourself for sure you can easily forget about the Modimole Monster in your head

      Christelle - 2012-04-20 17:52

And laaitie, I agree with you - can we keep race out of this!! Why the heck turn everything into a racial issue. This is a horrendous crime by one human(?) being onto another human - no black and white people!!!!

      sean.looney - 2012-04-20 17:58

look at all of u judging a man before he has even had his say in court! he is only ACCUSED and has not been convicted of anything yet. save the sharpening of your knives until the case is actually heard and a verdict has been reached!

      Mark - 2012-04-20 17:58

@Sam - you are confusing issues here. Yes whites do commit despicable crimes , but to get to the bottom of the problem we need to drill down into cultures where rape is more prevalent and explore the causes and cure these. FACT - Black south african men are more likely to rape than any other group in South Africa. This doesn't mean all black men are bad , we just need to find out what the reasons are and put a stop to. This issue is far to important to ignore.

      jmlongwe - 2012-04-20 20:37

Interesting there Mark, i assume you have proof from a credible source for your assumptions that describes that black men are more prone to rape per capita, if so then please post a link or something so as not to sound like a complete fool to the more rational thinking being that read this forum.

      sean.looney - 2012-04-20 21:14

@mark - where are the statistics to back up your claims? besides, i'd expect there to be a skewed percentage towards blacks as they account for 79.4% of the population whereas whites make up 9.2%.

      iwan.pieterse - 2012-04-20 23:45

Demographics of South Africa - as per 2001 census https://www.cia.gov/library/publications/the-world-factbook/geos/sf.html Prison demographics - as on the last day of 2011/02 http://www.dcs.gov.za/WebStatistics/inmate-gen.aspx  Adjusted for demographic size differences: Asian 5.7% Coloured 59.5% Black 29.6% White 5.2% All Races 100.0% If each demographic was equal in number, total crime would be commited by each demographic group as indicated above.

      James - 2012-04-21 11:27

dont find sympathy with rapists.this makes me sick to my stomach!!! BRING BACK THE DEATH PENALTY AND HANG. that is the only way we have even a small chance of regaining our safe streets again!

  • Thembi - 2012-04-20 16:20

DA please bring back death penalty I promise I will vote for you.Monyela will have acommordation, food and entertainment with my tax

      Sam - 2012-04-20 17:55

death penalty was for aprtheid people, injustice , the man has to appear before the magistrate to exhaust evrything , before a sentence is handed down, we are nt going to follow kangoroo justice in this country

      Nigel - 2012-04-20 18:08

remove his penis & give him hard labour, give him a pick & let him break rocks for 30 years, that way he will earn his food & it will be a serious deterrent for others.

  • Brent - 2012-04-20 16:24

Time to face the consequences for your actions, and this will hopefully serve as an example for all other scum bags out there.

  • Shirley - 2012-04-20 16:24

If he is scared-just imagione what his poor victim felt like!!!! Shake, rattle nad roll all youb like-it still wont be near enough to what you deserve!!!!

  • Biggs - 2012-04-20 16:28

I can tell you, he is not shaken. The only thing that can make him visible shaken if they can chop off his balls

  • Jayson - 2012-04-20 16:29

I would rather see him twitching at the end of a rope.

      Angela - 2012-04-20 17:54

Please no death here. What happened is indescribable but if you ask the life-sentence prisoners, 99% of them would tell you that they'd much rather be executed. I say, this man, along with his companions should spend the rest of his life locked up in cell, in a complete isolation.

      Col - 2012-04-20 18:26

Agree with you bud.Hang em all.

      Jayson - 2012-04-20 18:27

Your compassion is admirable Angela. However I don't think we see eye to eye on this matter. These low life scum buckets showed no compassion or remorse for there horrific crime against a innocent young lady. These monsters don't deserve to breath our air. They gave up that right away when they brutally gang raped her. And still had the nerve to laugh and joke about it. It just shows what kind of people they are. HANG EM HIGH.

      shireen.abbas - 2012-04-20 18:44

Totally agree jason !! They don't even have the right to breathe our air ! Hang them high !

  • Junaid - 2012-04-20 16:39

Let him stand trial in Saudi Arabia.

      Christian J Denyschen - 2012-04-20 16:58

lets send them to china with 10kg cocaine

      Christian J Denyschen - 2012-04-20 17:06

u know what lets send all our murders and rapist with drugs to country's who still have the death penalty for smuggling drugs , i'd rather have SA be known for a country who smuggles drugs then rape capital of the world.

      marina.poniatowska - 2012-04-20 19:13

Please, in Saudi the girl will get stoned or be forced to marry this monster.

  • marina.poniatowska - 2012-04-20 16:40

Who cares? Did he care when the girl was afraid? Turn him over to the community and lets see how he manage real justice.

  • Emily-Jane Elson - 2012-04-20 16:47

Visibly shaken?? Aah Shame.. Poor Oke - NOT!!! His turn to suffer now..

  • Mandy Stone - 2012-04-20 17:02

@Jack: oh please! it's not only black men that rape women! I have been almost raped, raped and date raped in that order in the space of 2 years and all by white guys! It seems to be a generalised mindset towards women in this country among many of our menfolk that women are there to be abused and controlled. Sadly enough.

      Pelo - 2012-04-20 17:16

Sorry to hear that mandy.heres a hug for u my angel (o),all will be well. Leave fools like Jack to be just that "Fools". Jack must just go hang himself on a tomato tree with a wet toilet paper and he must take the stupid rapists with him

      Mark - 2012-04-20 18:01

Mandy sorry to hear about that - however the facts are that black men are more likely to rape. You can't argue the numbers to do so would compound the problem that we are facing.

  • valcooperRSA - 2012-04-20 17:07

Ag shame hey.....if he wants sympathy....i suggest that he go look for it ..he will find it in the dictionary between sex and syphilis.....I hope every shaky moment he has will make him think of the crime he committed and see that girls face of his victim......do they shave dreads off in prison...wonder if he will apply for bail....and if he will get it.....kangaroo court waiting for him....suffer you vile monster

  • Deon - 2012-04-20 17:15

    no bail for rapers!

  • Chriskoi1 - 2012-04-20 17:18

  • Chriskoi1 - 2012-04-20 17:19

  • meredith.r.pollock - 2012-04-20 17:27

Visibly shaken?????? WTF was this poor mentally challenged girl while you were raping her, i'm sure she was more than "visibily shaken".. Rot in jail & then spend your eternity burning in hell you bastard, i have zero sympathy for you & your being visibily shaken!!! I hope you end up in a cell with a nice big fat dude that will enjoy making you his "bitch"... And if you happen to dodge the bullet of jail, I then hope your community will then take the law into their own hands where you are concerned!!!! Sick Bastard!!!!

  • Wanda - 2012-04-20 17:30

Put shackles in this man's penis, so that he won't shake again.

  • miehleketo.ndlovu - 2012-04-20 17:36

    no sympathy,justice must be done!!!!!!

  • Andrew - 2012-04-20 17:53

I am sure when the death penalty applied he would be even more shaken if he he knew he would swing which he should!!!!

      Msika - 2012-04-20 20:36

Death penalty will not make any difference in reducing crime in this country, the only difference would be that we wont have take care of this scumbags while in prison, for the rest of their pathethic lives and waste tax payer's money. Look at countries where death penalty is applied like America, they execute criminals almost everyday. Most convicted offenders would prefer execution than life improsnment, which to them seems to be an easy way out, rather than being kept in a lonely and empty place where they will think about their horific crimes for the rest of their lives.\r\n\r\nSo, rather keep them in that empty space for the rest of their lives and add hard labour on top of that. That would be a severe prison sentence to me.

  • Nigel - 2012-04-20 18:05

how shaken do you think the gang raped sodomised girl is, who gives a F***K how the accused feel, prison is too good for them, give them 30 year hard labour, that will sort the barstards out.

  • Nigel - 2012-04-20 18:15

what kind of example do you think is sent out when our president is accused of rape & idiots like Malema say that she enjoyed it, its no wonder Interpol has now named SA as the rape capital of the world, with leaders like this, who needs enemies.

  • Gail - 2012-04-20 18:16

Visibly shaken??? WTF!!! How visibly shaken was the poor victim and did he care about her??? I get a vision of myself forcing a gun into his mouth and ......

  • Lynda - 2012-04-20 18:17

Is this supposed to make us feel sympathy......???

  • catgirl1971 - 2012-04-20 18:29

Bring back the death penalty! If the noose is too 'barbaric' then the electric chair or lethal injection will do - preferably lethal injection as electricity costs a lot of money these days. Then we can see just how 'shaken' these criminals really will be!

  • Gemma-Leigh - 2012-04-20 18:37

Please, someone fill me in. Isn't this the man they found the gang rape victim with? Now I'm not defending the man, but it was my understanding that the police assumed he had kidnapped the girl and kept her as a sex slave...but is there proof of this? Or have I missed something somewhere?

      Msika - 2012-04-20 20:10

He's still a suspect at this stage until proven guilty or otherwise by a court of law. There's still gona be a trial that wud probably last forever (unless mr scumbag pleads guilty), he need to apoint a lawyer (which I doubt he can afford one) or use one provided for by the legai aid board (paid fully by the tax payer) to lie on his behalf.

  • edandchris - 2012-04-20 18:44

No bloody bail for the rat!!!!!!!!!!!!!!!

  • Johann - 2012-04-20 19:04

  • di.hingley - 2012-04-20 19:50

I do not condone violence, but I feel like suggesting that the words "video gang rapist" is tattooed on his forehead and he is dropped off in the middle of Soweto, or put into the prison general population section!!!!! I also find the tone of this report sympathetic towards the accused, please God, let me be wrong!!!!!!

  • jmlongwe - 2012-04-20 20:44

So how different are all you people who lose all sanity and rational thinking calling to necklace someone before they've actually been proven wrong. You are calling for the guy to die, castrated etc when its only day 2 and hasnt been found guilty. Yet you are the first to call others barbaric because they did it. Food for thought. I hate rapists but lets not be barbaric about it.

      Msika - 2012-04-20 21:00

Welcome to new24 jmlongwe. You just qualified yourself to get a huge number of thumbs down with your comment. No rational thinkers, only emotional thinkers. U probably gkna get one thumb up and that would be mine.

  • Martin-Cullen - 2012-04-20 22:44

According to: www Wikipedia SA Rape International Stats : South Africa has the highest reported incident of rape in the world. The South African government reports that one of these reasons is the culture of patriarchy in South Africa. Its report states that patriarchy is firmly rooted in the country and fighting it is seen as attempting to destroy African tradition.. The danger from rape and sexual assault is compounded because of the prevalence of HIV/AIDS in South African townships. A woman being raped over the age of 25 has a one in four chance that her attacker is HIV positive and more women than men are affected from HIV/AIDS.[18][10] The perpetrators of rape in South Africa tend to be men known to the victim. It is reported that a husband or boyfriend kills a woman every six hours in South Africa

  • Martin-Cullen - 2012-04-20 22:45

Child and Baby Rape: South Africa has some of the highest incidences of child and baby rape in the world. In 2001, it was reported by the South African Police Service that children are the victims of 41 percent of all rapes reported in the country.[Although there are varying numbers on the amount of reported rapes of children, one report states that in 2000, 21,538 rapes and attempted rapes of children under the age of 18 were reported and another from 2001 states that there were 24,892 rapes.[ Some cite a 400% increase in sexual violence against children in the decade preceding 2002.A third of the cases are committed by a family member or close relative. Child welfare groups believe that the number of unreported incidents could be up to 10 times that number. The largest increase in attacks was against children under seven.

  • Martin-Cullen - 2012-04-20 22:46

A number of high-profile baby rapes appeared since 2001 (including the fact that they required extensive reconstructive surgery to rebuild urinary, genital, abdominal, or tracheal systems). In October of 2001, a 9-month-old named Tshepang was raped by an HIV-positive man and had to undergo surgery in Cape Town.In 2001, another 9-month-old infant was reportedly gang raped by six men, aged between 24 and 66. The infant required extensive reconstructive surgery in Kimberley, Northern Cape. Due to these cases and more, increased attention on baby rape prosecution has occurred. Sexual violence against minors older than the age of infancy is also extremely prevalent in South Africa. According to the Medical Research Council, more than one in four minors experience physical violence at home daily or weekly and more than one third of girls have experienced sexual violence before the age of 18. Its study also states that by 2009, 40% of all victims who reported rape to the police were under 18 and 15% were under 12 years old.

  • Martin-Cullen - 2012-04-20 22:53

Another issue with sexual violence against minors in South Africa is the sexual abuse and harassment that is reported to occur in schools by teachers and other students. According to the Human Rights Watch,] girls from all levels of society and ethnic groups have been subjected to sexual violence at school in bathrooms, empty classrooms, dormitories, and more. Police, prosecutors, and social workers have also complained that many incidents of sexual violence in schools are not reported to them because schools often prefer to deal with it internally, thus hindering justice against the perpetrators. The danger of sexual violence in schools has created a barrier for girls to seek education. HRW also reported that South African girls’ school performance suffers after an incident of sexual violence. AND so now we know FACTS in SOUTH AFRICA!!! It's a crisis and we as citizen need to do something about it. We can organise a Parents march in major cities to demand the return of capital punishment befitting the crime. SHAME! SHAME! SHAME! If we do nothing we can only expect more of the same!!! We have got to seize this opportunity and bring attention to amend the constitution which was written for meant to be written FOR the People and not FOR the Criminals as presently stands. Help our prosecutors, Help our Police, Help our Judges, Help our educational systems to bring about more stringent laws that will protect EVERY South African and save South Africa's future. !!!

      Genet - 2012-04-22 12:47

Thankyou for the well researched information. I feel physically sick reading this, and overwhelmed at how we are going to overcome this absolute disgrace. We certainly need to stop this immediately, but how. It really is a desperate sitution.

  • Tanie - 2012-04-20 23:06

Asked which language he spoke, a visibly shaken Monyela quietly said “Setswana”. Why didn't he say tsotsi taal? the bloody goetes they know Setswana when they are shaken in court.

  • Kelly - 2012-04-21 08:01

And so we have once again been made PROUDLY SOUTH AFRICANS - this story is on CNN - CNN reporters are asking questions that we have been asking for many many years already - THIS story affects everyone of us in our society because we are South Africans! These rubbish will be back on our streets within no time to do it again - next time it just may be one of our daughters mothers, sisters or friends!

  • Julie - 2012-04-21 08:15

Any rapist should be castrated in public without the aid of anaesthetics, then branded with the word "RAPIST" on the forehead and let loose among the community - guaranteed, just mete out this type of justice once or twice, rape crimes will drop by at least 90% !!! Why the heck should we - the already bled-dry taxpayers fork out X-amount to feed and clothe scum while so many good people out there are battling to keep body and soul together in these hard financial times???

  • Amanda - 2012-04-21 09:02

There should not even be a minimum sentence of life it should be the death penalty , not even animals behave like this.

  • Marlene - 2012-04-21 12:18

They are visibly shaken because they can't understand why they are under arrest because they think rape is normal !

  • Rob - 2012-05-03 17:10

Visibly shaken... Wait for a while 'pal'. If you think it is bad now, wait until you are 'incarcerated'. I am sure your fellow 'inmates' are going to love your 'dreads'. Even 'they' have no time for rapists - never mind a rapist who abused a poor 'mentally retarded' young girl. Boy are you in for a surprise. ENJOY.......
