Witness hiding something - Jub Jub lawyer

Johannesburg - A metro officer testifying in the murder trial of Molema Jub Jub Maarohanye and Themba Tshabalala was hiding something, defence lawyer Ike Motloung told the Protea Magistrate's Court on Monday.

"You [are] playing that you know nothing, which shows you [are] up to something," he said to Constable Velemina Mojela.

Maarohanya and Tshabalala face charges of murder, attempted murder and driving under the influence of drugs and alcohol.

They were allegedly drag-racing when one of their Mini Coopers ploughed into a group of schoolchildren on Mdlalose Drive in Protea North on March 8 last year.

Four children died in the accident and two others suffered severe injuries, including brain damage.

Drug tests

Mojela testified that she knew nothing about the accident and that drug tests on both of the men were done in 15 minutes.

"A urine sample is not taken in split seconds," Motloung said during cross-examination.

Mojela testified that she arrived at work at 18:55 and that drug and alcohol tests on Maarohanye and Tshabalala were completed by 18:15.

Mojela had brought the log book from the day of the accident to court with her.

She said she did not check the time when she started the drug and alcohol tests, but did record the time they were completed.

She explained to the court how drug and alcohol tests were done and what apparatus was used.

The evidence was to prove that the two men had tested positive for drugs and alcohol.

Earlier in the day, Motloung accused Mojela of contradicting herself.

      Watch, SA- here comes the first loophole to shoot holes in the case. It is deplorable that this type of thing is allowed. How much more proof do they need regarding the identity of the drivers, let alone thir state of sobriety???

      Nowhere did it state that she she conducted the tests. Its quite possible that she arrived at 18:55 after the tests had been completed at 18:15 as per the logbook

      @Refilwemu, I have no doubt that you would be the first to claim that you live in a democracy, if so, then consider the following. In a Monarchy people a ruled over (Swaziland), in a democracy people are governed over! It's been like that since both systems were developed, many, many years ago. So, nobody "rules" over us in South Africa.

      these reports are exactly what is coming out of the trial and the material is captured by SAPA court reporters. If it sounds crazy, then ask yourself what is happening in SA courts.     Realy, what further evidence is still required here?? Doesnt the judge and the lawyerz know who are the car owners? Is it not clear that these cars caused accidence and school kids died and others injured? So what else does the court want, or its just waste of time and money? I wont be suprised if these guys are found not guilty!!!

    This is so bloody frustrating. It'swhen stuff like this happens that that one wishes that it wasdealt with by "Kankaroo Court". Then money or connections means sweet nothing, if you are found guilty you are sentenced straight-away

    The thing with criminal law is that it operates on the presumption of innocence until proven guilty. These cops might be caught out because of their incompetence as a result of the way the law works even though i would like to thing these guys are guilty. However, what is not in doubt is that these guys did cause the death of these children for that they should be punished.

      They are not guilty of murder. They will be found not guilty. They are almost certainly guilty of culpable homicide. This is why they have been charged with murder so they can be acquitted..

    People let's not loose the point here, this is not a political matter. The only people who needs to hang for this are the two culprits who murdered innocent children & r showing no remorse. Even if the courts find them guilty it wont b enough, they need to plead for forgiveness & show some remorse. Damn they KILLED & KILLED & left others deformed. This is not a political issue but a national problem these celebrities get away with murder.

      Damn right you are Penelope, and they get away with the assitance of lawyers. There lies the problem. The Judge should just stop this charade, forget about the "tests" and tell the defendants and lawyers that the court will now deal with the fact that 2 motor cars , whilst speeding, and driven by the 2 defendants, lost control and killed and injured innocent children. Those are the facts simple and straightforward, pissed, drugged up or not!!!

    It looks like no one trusts the courts any more, that what they have done to the justice system. maybe we should use the french system guilty until proven innocent, then maybe so many would not escape the law. Your responsiblity to man kind starts when you take the drink or substance and not when you cause problems.
