Woman suing husband for taking 2nd wife

Cape Town - In a bitter twist of events, a Cape Town woman is suing her husband for R1.3m for taking a second wife, after she refused to have sex with him for seven years.

The 30-year-old businessman told the Daily Voice his wife had various excuses for not having sex with him.

The man said she turned their marriage into a mockery.

Five years later he married his second wife and was married to both women according to Islamic belief.

"It is...allowed for a husband to take a second wife, but… this depends on if it was done unethically and immorally," Sheikh Ebrahim Moosa explained to the paper.

"One has to take into account the marriage contract and any verbal agreements that were made," he said.

Under Islamic law, a wife must have "sound reasons" for refusing her husband. 

"For example, if something is wrong with her medically. If she does it on purpose, she immediately loses some of her rights already.

The first wife has now been living with her family for the past two months.

"She told her mother I took a new wife and that we had a child together, but when I told her mother why, she was shocked," he said.

The wife declined to make any comment on the matter.
