Woman tells of rape by ANC MP

2012-02-19 12:53

Cape Town - A woman who has accused a top ANC MP of raping her has broken her silence about her alleged ordeal.

Sikhumbuzo Eric Kholwane, 39, who chairs Parliament’s communications portfolio committee, was arrested shortly before Christmas on charges of rape.

However, news of his arrest emerged only this week following his appearance in court in Cape Town on Tuesday.

This week he will have to meet the ruling party’s chief whip, Mathole Motshekga, in Parliament to explain himself.

The 26-year-old complainant, who may not be named for legal reasons, alleged she was assaulted in December following a row between the couple over their relationship.

Met through Facebook

The two had met last March through social networking site Facebook and she saw him whenever he came to Cape Town. In June last year, she suffered a miscarriage.

He had fathered the child, she claims. She tried to call him but he did not return her calls.

The woman said after the argument and on the night of the alleged rape, she had slept in a car outside his home in the Cape Town neighbourhood of Grassy Park. She had not wanted to go into his house after the fight.

“When I woke up I was inside the house on the couch and he was busy on top of me,” she said, adding that she did not know how she had landed up inside.

“I said: ‘What are you doing?’ He said: ‘You always do this... You want me to take you. I’m going to show you what I am made of!’,” she claimed.

Screaming

She alleges that she managed to leave the house after “screaming and shouting” and called the police. The woman said she was determined to see the case through.

“He raped me. Why should I drop the charges? He told me I am wasting my time because he is a member of Parliament. (When the police arrested him) he was in the back of the van...(when they realised he was an MP) they took him out of the back and put him in front you know, like a gentleman that (has) been accused of rape,” she alleged.

“That’s when he told me: ‘I told you, you’re wasting your time’,” she claimed.

Kholwane told City Press on Friday he would not comment on specifics of the case but said he was giving his full co-operation to the police.

A blood sample for DNA testing was given to the investigating officer on Wednesday.

Police had apparently struggled to track him down to provide the sample after his earlier court appearance.

Motshekga said he did not know the details of the case, but had asked for a meeting with Kholwane.

“We have a culture that you are not guilty until proven guilty. And I can’t even start talking about what the ANC will do as I don’t have the facts,” he said.

The police’s sexual offences unit in Wynberg, Cape Town, which arrested Kholwane, pulled a veil over their investigation this week.

City Press was told by officials close to the investigation that this was because “Case 460 Grassy Park” involved an MP and was considered highly sensitive.

Kholwane, who hails from Matsulu in Mpumalanga, was arrested on December 20 last year and the next day was released on bail of R500. On Tuesday, the case was postponed until March 15 to give the investigator time to collect a blood sample.

Kholwane, who spoke to City Press from Durban, said he did not want to say much about the case, but was surprised to read details of it in the media. He did not want to comment on claims that the complainant was a girlfriend.

“Since the complaint was lodged, I have not spoken to the complainant. But I do not want to say something that could influence the case,” he said.

Kholwane’s bail conditions stipulate that he may not contact a state witness nor enter the suburb of Mowbray.

He has been an MP since 2004 and previously served on the portfolio committees for public enterprises and safety and security.

      Marcell - 2012-02-19 13:40

      You forgot the taxi money.

      Annette - 2012-02-19 18:12

Not to be pissy, but how does she not remember, getting onto his couch as she was sleeping in the car. he carried her in fast asleep,??? he drugged her???

      Stefanus - 2012-02-19 22:12

Should we add Rape to the list of national sports and recreation activities in SA?

  • Terrence - 2012-02-19 13:10

For why is this news ????? Give me , us , a break !!!!

      Gareth - 2012-02-19 13:18

Don't speak for us Terrence, Rape is not a joke, it the most disgusting of crimes. To shed light on your intellectually limited question - Its news as a result of a high ranking ANC MP being involved. My full support goes to the lady in this case and I sincerely hope justice is served, far too many "men" in this country are no better than dogs and should be "put down" as they serve no purpose to society.

      Jeffrey - 2012-02-19 14:09

@Dawood, Go back to India or wherever your type breed. We don't need racists like you in SA. Beastley never mentioned anything about race, he just highlighted that rape is a disgusting crime.

      Gareth - 2012-02-19 14:33

@Dawood - Wow, what an intelligent response, it must have taken you literally seconds to draw racism into this one. If you could read, you might have noticed I said "I hope justice is served", which means "May the law prevail". I was alluding to the never ending stream of rapes that are reported, not to mention the ones that aren't, when i referred to "dogs". So you totally missed the point in your attempts to make this a race war, if it were one why would I care about the victim? You are so blind to logic that I doubt you'll understand what I mean. There is no greater fool than the one who thinks himself not a fool, and you, Dawood, are a class A, top drawer, A team fool. Your callous remarks I'm sure are much appreciated by the woman of this country who are being victimized by the filth that rape, and should this ANC MP be found guilty then I sincerely hope he gets put down as he is of no use to any man, woman or child. I am a born and bred South African Dawood, in case your blinkers only allow you to see one way in your one sided world. If you comment wasn't so sad it would be funny, but unfortunately it is never funny when people are abused.

      mpoovalingam - 2012-02-19 14:43

what if she was your mother or siater

      nanasei.kobbina - 2012-02-19 14:46

      you are a rapist terrence

      Tuner - 2012-02-19 15:17

This unnecessary and pathetic comment by Terrence has got out of hand. A member of parliament being accused of rape is news. Dawood, if Beastley wants to make a comment on this matter then it is his democratic right to do so. Its called freedom of speech. Even the accused comments that she is wasting her time show arrogance and are very suspect.

      Gareth - 2012-02-19 15:22

@Dawood - In true spirit of a moron you cease to give up your mute point. If you could be so kind to point out where I said this man is guilty? I said "I hope justice is served" , my word you are thick. Let me spell out my point in language you can grasp. - in South Africa there are a huge number of report of rape against woman and children. The people who commit these crimes are worse than animals and do not deserve the air they breathe - is that simple enough for you, can you see the point or are you too fixated on calling me a white, European racist with a one-dimensional education. Try and think about someone other than yourself Dawood, you may just find the world consists of more than just you and your wants and needs. This is horrible news and any actions of abuse should be treated with condemnation. The courts may or may not decide the truth, but the act of rape or abuse is the lowest form of behavior, which you should find abhorrent, yet you still feel calling me a racist is decent alternative to discussing the news article or bothering to read properly at comments made.

  • Rebaone - 2012-02-19 13:11

If he escape this then i would know that he is a real comrade as they always do and i would know that our government is also corrupt for allowing him the chance to go free.

  • cosmos.ndebele - 2012-02-19 13:16

Relationship went bad!!! Above that its disgusting

  • Duncan Thabiso Mphailane - 2012-02-19 13:26

I will not condone any form of abuse against any woman but I'm sorry, I don't believe her. The details just don't make sense. I think she's just a manipulative ex willing to abuse the law to get her revenge and get a little bit of fame in the process.

      Dawood - 2012-02-19 13:44

look Duncan as i've said above...this matter is for the courts..lets not apply caucasian(european) thinking here and find the guy innocent or guilty(cos of his affiliation & colour)..In a true democracy(unlike europe & the us) like ours the courts will decide his fate, and if he's found guilty, apply the death penalty or castration, and if he's innocent, then lock her up...pure and simple..

      Jeffrey - 2012-02-19 14:12

Look Dawood, This matter is for the courts, and we don't have Sharia law here. In muslim countries if she was raped she would be punished and the rapist would get off scot-free. We have real democracy here just like in Europe and the US, not like the Islamist countries with their mock elections.

      Jeffrey - 2012-02-19 14:18

Look Dawood, Innocent until proven guilty only applies once one is before the court, it is the legal right of one who is the accused in a criminal trial.Until such time people can assume whatever they wish, and if they are proven wrong the alleged rapist can then sue them. You have no conception of democracy or the law, you just come up with your racist rant.

      Garth - 2012-02-19 14:28

@duncan the racist - your comment smacks of bitterness and 18th century tribal mentality where a woman's body belonged to the closest man. @dawood - useless, worthless troll.

      Riaad - 2012-02-19 15:19

@Jeffrey "In muslim countries if she was raped she would be punished and the rapist would get off scot-free." What utter nonsense. You do not know Shariah law. A man allegedly committed rape in the time of the Prophet Muhammad (pbuh). The woman's testimony was accepted and the man was stoned to death. This is clearly documented in the Hadith literature. Contrast the above to the SA norm where rape is happening every 26 seconds. And why? Because there is no effective deterrent to would-be rapists! The law fails the masses and the punishments don't fit the crime. Convicted rapists are often released after a short sentence - to rape again!

  • Kaven - 2012-02-19 13:31

i wouldn't be surprised if he wasn't plead guilty and if the victim was telling the truth. Lets all give a round of applause to our corrupt system which the government has set. The neanderthal ANC MP may walk out a free man but he knows best if he has committed a crime or not

  • Garth Baldwin - 2012-02-19 13:39

    He should run for president!

  • Larry - 2012-02-19 13:45

Would this have been reported under the proposed Information bill? Typical ANC though.

  • Richard - 2012-02-19 13:54

Rape is so serious. People who are found guilty shuld be locked in jail for a long time.I also wuld like the public to severely criticize those who claim to be raped when they just want revenge, when no rape ever taken place.

  • Christopher Thunder Linde - 2012-02-19 14:12

R500 bail for rape. Nuff said. Pathetic.

  • Victor - 2012-02-19 14:20

She had sex with him previously, she was in his house not knowing how she got there? And then when she couldn't get what she demanded, she opened a case of rape??? This story sounds like a revenge case, not a rape case. Why did she in the first time engaged in a intimate relationship??? Waste of tax payers money.

      Garth - 2012-02-19 14:38

In this day and age, with supposedly the most modern constitution, we still find ourselves surrounded by Neanderthals. Your family leave you behind on purpose when they died out 40,000 years ago? Innocent until proven guilty should apply to the victim, first and foremost. Woman is not here at man's behest.

      Riaad - 2012-02-19 15:24

That's assuming that she is the victim, Garth! I agree with Victor, the story does not add up.

      roger.pacey - 2012-02-19 18:03

Under South African law, there is such a thing as marital rape. Previous consensual sex does not obviate rape in a later encounter.

  • Blane - 2012-02-19 14:53

He will do an OJ Simpson - walk .

  • Dawood - 2012-02-19 15:11

as usual, the racist news24 team cancels the true honest comments..anything anti-white is deleted..just like your big bro's in the states

      Gareth - 2012-02-19 15:28

Possibly they are just removing the statements which reflect any racist view - yours seem to qualify in my opinion. How exactly do you draw a racist conclusion in this matter in any event? Besides your comments no one else seems to find the link, its a news article about a rape by a high ranking ANC MP, yet you wallow in the gutters of racism in order to obtain notoriety. Quite pathetic.

      Shannon - 2012-02-19 15:40

Dawood... been following your comments here. You have a big chip on your shoulder. What you got against whites anyway? Sound like a bit of a racist... or you just a troll?

      Balan - 2012-02-19 16:02

Hey you Dawood, what I sum up here is that you are an idiotic racist who fails to read within the lines

      Gareth - 2012-02-19 16:38

You Dawood are the omly racist here, which I must commend you for doing such a sterling job. As previously stated your comments are devoid of logic, missing the point and with your comment to Shannon, sexist too. If there were a prize for a total idiot, you would win it hands down, unfortunately there is no prize and you just get to live with the incredibly small mind you have. Any argument, like yours, that uses racism as its prop cannot be construed as intelligent. Despite it being pointed out to you by pretty much everyone here you still seem convinced of your levels of intellect. Perhaps you and your one friend on Facebook have the same views, but two people dont make an argument Dawood, they just make a pair of fools.

  • Yolisile - 2012-02-19 15:55

Rape on these days are difficuty to judge bcoz these young ladies fell for these gentlemen and when relationship is not going well claim for rape. You last see ursel outside then all of a suden u are inside. HOW DID YOU OPEN UR LEGS? Was she drugged, then the case is very serious, let the court proves it. Ladies in Cape Town! Sir Fergurson also raped someone ther and what happened to the case.....................

  • Bobo - 2012-02-19 16:11

Real men don`t rape. Finish en klaar.

  • hadedah - 2012-02-19 16:22

Personally all rapist found guilty should have their testicles removed before going to prison and then have a long term in prison to think about what has happened.

      Graham - 2012-02-19 16:36

Castration by brick! Then through him in with sodomites!

  • Ron - 2012-02-19 16:53

This Dawood fellow is obviously a Coloured kid who is bitter at society as a whole, and is trying to make an adult point in this forum. You can see from his grammer ("u" instead of "you" - "ppl" instead of "people", etc.) not to mention the immaturity of his arguments. Ignore him and he'll get back to his computer games and leave the adults alone.

      Alan - 2012-02-19 17:47

Agreed, ignore the troll. He is just rying to stir up trouble. People, please don't waste time, effort, or space on this page replying to, or commenting about Dawood.

Illegal sex is ruining life for wise people.

  • Kusleg - 2012-02-19 18:16

While rape is a callous act and must be condemned in the strongest terms, this woman also seemed not to be vigilant enough. *2 months in a relationship, she was already pregnant by the "rapist". *They had an argument over the relationship and she chose to sleep in the car....was she a street kid with no home? Why did she not opt to go back to her home for the night? *She was so fast asleep that she was carried, cat walked into the house, gently layed on the couch without noticing...she must have been high on something very illegal. *She only woke up when the "rapist" was probably almost through with her. The dear sister must at least try to rephrase her recapturing of events otherwise the "rapist" might get away with it.

      Josh - 2012-02-19 23:33

At Alex...So we are victimizing her are we?...Tell me, did she say she was drugged?? how then did she get from the car to his couch...get undressed and only to wake up when the perpetrator is almost done...Alex you have to try and see both sides...we are not saying that she is lying ...but the probability of the Judge believing that...well is as close as to me convincing people that i have been to heaven and back.."Just saying"

      Alex - 2012-02-20 00:26

As per my comment.... You have not consented to a sex act if you are... Asleep.

  • Elvis - 2012-02-19 20:06

"Until lions have historians, tales of hunting will always glorify the hunter". Justice is about delivering justice to the two parties involved. The law is argued on evidence to deliver a fair judgement that considers both sides of the story. We should remember that people have been wrongfully imprisoned and they paid for crimes for which they didn't commit. In same vein, perpetrators have escaped the grip of the law untouched because they have powerful influence, they're the untouchables. Let's reflect on these issues.

  • Fawzia - 2012-02-19 20:42

Hi Jeffrey please do homework on Sharia Law if you really want to know & not make uninformed comments. Riaad has the correct interpretation of the situation & incidentally the situation in s.a. is just not fair or just.Rape seems to be norm. The judicial system in S.A. needs a total overhaul with reinstatement of the death penalty. Update your knowledge o your mental database on Sharia Law pls.(No offence meant and hope none taken)

  • Bongeka - 2012-02-20 04:03

This facebook is coming with too many rape cases.Unfortunately we can't really know the real truth about what really transpired between those two.But S'khumbuzo if you really raped her brother then you're not a real man and I'll hate you for that.Sorry to say that to you, but it's what I believe in.REAL MEN DON'T RAPE.Even worse if you are using your MP position to get away with murder. That's disgusting. But like I said before that the only people who know the truth is you and the 26 year old mistress. The judges will find out the real culprit and give him/her what he/she deserves. We as the members of the public must just cool down and let the law take it's course.I know that it's usually a long process but eventually the truth will come out and set us free. Some people are just so insensitive and dumb.Who said anything about a shower and a taxi fare now?Grow up people please.
