Yengeni won't pay Kebble debt

Cape Town - Mining magnate Brett Kebble gave about R260 000 to the former African National Congress chief whip Tony Yengeni, according to the trustees of Kebble's bankrupt estate.

This allegation was contained in affidavits in an application for a summary judgment that would force Yengeni to pay this amount back to the estate.

Yengeni, a business man from Milnerton, has already given notice that he will oppose the application.

Kebble was gunned down on his way to dinner on September 27 2005.

On April 25 2006, the High Court issued a temporary sequestration order against Kebble's estate. The order was finalised on June 13 2006.

Anna Venter, Rainotes Nduna and Johannes Klopper were appointed as trustees of the estate on September 11 2006.

According to the affidavits the trustees claimed that Kebble had made the following payments to Yengeni:

  • May 22 2003 - R80 000

  • September 9 2003 - R60 000

  • December 12 2003 - R25 000 (cash)

  • January 29 2004 - R4 617.70

  • April 16 2004 - R60 000

  • December 22 2004 - R30 000

    Which came to a total of R259 617.70.

    Except for the payment of December 12 2003, all the payments were made by electronic transfer and paid into Yengeni's account at First National Bank in Milnerton.

    The trustees claimed the money was paid to Yengeni two years before the estate was sequestrated.

    Immediately after every deposit, Kebble's liabilities exceeded his assets.

    Yengeni was accountable, therefore, and had to pay the money back to the estate.

    Yengeni refused to pay back the money.
