Father loses appeal against life sentence for raping his daughters

Pietermaritzburg - An appeal against a life sentence by a father jailed for raping his two pre-teenage daughters was dismissed by the KwaZulu-Natal High Court in Pietermaritzburg on Tuesday.

The father's father - the children's grandfather - had been jailed for 20 years, also for raping the children. He was also refused leave to appeal by the magistrate. 

In addition both children had been indecently assaulted.

The names of the two men have been withheld to protect the identities of the man's daughters.

Judge Daya Pillay, sitting with Judge Nompumelelo Radebe, dismissed the father's appeal against his sentence.

When arrested, the father was 41 years old and the grandfather 66 years old.

Gainfully employed

An advocate said that the father's sentence was shocking because he had pleaded guilty, showed remorse, had ceased assaulting them eight years before his arrest, resumed his normal fatherly duties, his daughters had forgiven him and their grandfather, and he had no previous convictions.  

He was gainfully employed when arrested.

Probation officer N C Nkosi said that when the girls reported the matter to their grandmother the offences stopped. The matter was discussed by the family and the relationship progressed into a good one. He had apologised and the family had decided not to charge him criminally. 

Correction Officer T M Morajani said that the elder of the daughters believed that her father had received enough punishment while he and his father were in custody for four months.  

She reportedly felt that correctional supervision or "house arrest would be better as they would continue helping the family".  

The younger daughter told Morajani that she had forgiven both accused.
