Interdict on ANC North West region's conference, provincial council rescinded

Mahikeng – The ANC in the North West extended an olive branch to dissatisfied members of its Bojanala region after the interdict the region obtained last month to stop the regional elective conference and provincial general council from taking place this weekend was rescinded.

The party's North West secretary Dakota Legoete said the party would engage the "members who feel aggrieved" after the weekend's conference.

"Yes, I still think the matter can be settled outside court," he said.

The verdict and the order rescinding the previous judgment was delivered on Friday by Judge Nadia Gutta. 

Legoete said the Bojanala region's conference and the provincial general council would go ahead as scheduled.

Disgruntled members of the Bojanala region instituted court proceedings over allegations that at least 40 branches were not constitutionally launched. They applied for the now rescinded interdict, which was granted on August 11. ANC secretary-general Gwede Mantashe and the provincial and regional ANC leaders were the respondents in the original application and brought the application to have the interdict rescinded. 

More intraparty legal battles

Legoete said the complainants didn't exhaust all of the ANC's internal processes to have the matter resolved.

The  ANC in the North West was represented by Advocate Tembeka Ngcukaitobi, who also represented the ANC members who won their legal battle in KwaZulu-Natal earlier this week.

The KwaZulu-Natal High Court in Pietermaritzburg nullified the 2015 provincial conference on Tuesday after some members argued that there was vote rigging and other irregularities ahead of – and at – the conference. The provincial executive committee has said it will appeal the judgment.

These two aren't the only intraparty legal battles in the ANC at the moment.

In the Eastern Cape, the party's biggest region in the province, OR Tambo, on Thursday asked the court to scrap the outcomes of a regional elective conference. This is expected to further delay the provincial elective conference, which has already been postponed three times.
