Murder accused artists' case re-opened after evidence about his alcohol consumption surfaces

Cape Town – Artist and murder accused Zwelethu Mthethwa was granted leave to have his case reopened in the Western Cape High Court in Cape Town on Monday.

Closing arguments would have been heard last Tuesday but Mthethwa's lawyer William Booth applied to have the case reopened, Netwerk24 reported.

Mthethwa is facing charges relating to the murder of Nokuphila Kumalo, 23, on April 14, 2013, in Woodstock.

He allegedly kicked her repeatedly and stepped on her and she died within seconds due to a very heavy blow.

Mthethwa was apparently caught on CCTV cameras as he parked his Porsche in Ravenscraig Road.

He pleaded not guilty and did not hand in a plea explanation or testify in his own defense.

R2 600 alcohol bill 

Booth said after closing the case they had received new information to support Mthethwa's claim that he has no recollection of the events of April 13 and 14, 2013, due to high alcohol consumption.

They handed in financial statements proving that Mthethwa spent R2 600 on alcohol at the Corner Lounge in Gugulethu.

Booth wants to recall psychologist Professor Tuviah Zabow to the stand to testify about Mthethwa's memory loss.

Advocate Christhenus van der Vijver, for the State, objected and said Zabow's testimony would be based on hearsay.

Judge Patricia Goliath granted Booth's application to have the case reopened and the case was postponed until Wednesday, when Zabow will testify.
