Dalai Lama visa case dismissed with costs

Cape Town - An application on whether it was constitutional for the government not to grant a visa to the Dalai Lama last year, was dismissed in the Western Cape High Court on Friday.

Judge Elizabeth Baartman dismissed the application by the Inkatha Freedom Party and the Congress of the People with costs.

The Dalai Lama cancelled his intended trip to South Africa to attend Archbishop Emeritus Desmond Tutu's 80th birthday on October 4.

He said he had done so to avoid inconveniencing the South African government.

The government's failure to grant the visa, however, sparked a public outcry with Tutu accusing President Jacob Zuma's administration of being "worse than the apartheid government".

The IFP and Cope subsequently filed an application in the Western Cape High Court for an order declaring Home Affairs Minister Nkosazana Dlamini-Zuma's handling of the matter unlawful and forcing her to treat future applications by the Dalai Lama fairly.

IFP leader Mangosuthu Buthelezi has invited the Dalai Lama to visit him in 2012.

    Comrade Unelected President Lekota of Cope, this is purely a waste of money. Now you are saying Shilowa has been expelled for misusing COpe's parliamentary funds but you are doing the same. We are, unlike you, procedural and we will not expell you but vote you out in the next elective congress (if you will still be occupying the position). In the meantime, the said costs should be born by you sir.

    The Dalai Lama may very well be a good human being; so are millions of other people. He is also the most overrated monk in the world. Ditto for Bishop Tutu - he should now really retire to a quiet life of prayer or risk being referred to as Bishop Gaga. Ken Meyer, Cape Town

    The Dalai Lama should apply for visas about six years before he intends coming... and apply again every year... IFP and COPE were seriously crazy to think they could win a case when the Dalai Lama had withdrawn his application. Even if it is true that the application was delayed forever and a day for political reasons, the fact is he withdrew his application. That was his big mistake.
