Johannesburg - Legal papers have been served on former Tlokwe mayor Maphetle Maphetle and other councillors refusing to vacate their offices, the DA in the North West said on Friday.

"Officials have also been instructed by the ANC not to allow the new DA administration access to these offices," Democratic Alliance provincial leader Chris Hattingh said in a statement.

"The DA is prepared... to do what is necessary to bring immediate stability to the municipality."

Hattingh said Maphetle asked for a meeting on Monday to "resolve matters", which the DA was prepared to attend.

DA Councillor Annette Combrink was voted in as the new mayor on Tuesday, the second time since November.

Hattingh said 29 councillors of all parties, including the ANC, unanimously voted on Tuesday to return Combrink to the position of mayor.

On Wednesday, the North West ANC's provincial disciplinary committee said its 14 councillors, who voted to unseat Maphetle, were expelled from the party.

They would also be removed as Tlokwe councillors.

Municipality spokesperson William Maphosa on Friday confirmed that Maphetle, speaker Barei Segotso, and members of the mayoral committee were still occupying their offices.

"They are still in their offices and they are not going to vacate," Maphosa said.

"The meeting the DA and the expelled ANC councillors held was an illegal meeting so we don't recognise the decisions taken at that meeting."

He said Maphetle received a letter from the DA's lawyers.

"We have seen the letter but we will not vacate. They can take it forward if they want to."

Maphosa said the speaker would convene a "proper" council meeting on 12 July.
