Malema meets ANC's midnight deadline

2012-04-19 15:35

Johannesburg - Suspended ANC Youth League leader Julius Malema and two other leaders submitted their written heads of argument to the ANC appeals committee on time, party spokesperson Keith Khoza said on Thursday.

Malema, ANCYL secretary general Sindiso Magaqa and spokesperson Floyd Shivambu had until midnight on Wednesday to submit their written arguments to the ANC's national disciplinary committee of appeal (NDCA).

They were scheduled to make the submissions last week, but the matter was postponed because their lawyer was not available and they had also asked for a new lawyer.

The ANC was expected to submit its written heads of argument on Friday.

Malema was expelled from the ANC in November 2011 for sowing division in the party and for bringing it into disrepute.

He was found to have done so by unfavourably comparing the leadership style of President Jacob Zuma to that of former president Thabo Mbeki, and for remarks concerning bringing about regime change in Botswana.

NDCA dismisses Malema’s appeal

Despite the expulsion Malema remained ANCYL president until all options to overturn his sentence had been exhausted.

However, he was gagged last week when the ANC's national disciplinary committee suspended him from the ANC after he called Zuma a dictator. The conditions of the suspension prohibit him from exercising any duty as an ANC member, president of the ANCYL or member of the Limpopo provincial executive committee.

On Tuesday, the NDCA dismissed Malema's bid to have his temporary suspension from the ANC in this matter set aside. The two disciplinary proceedings were separate.

Shivambu was also found guilty of sowing division and bringing the ANC into disrepute. He was suspended from the ANC for three years for swearing at a journalist and for issuing a statement calling for a change of government in Botswana.

Magaqa was suspended for three years for making derogatory remarks about Public Enterprises Minister Malusi Gigaba.

This was suspended for three years on condition that he apologise to Gigaba within 15 days. Magaqa apologised to Gigaba, in a statement sent to the media on March 10.

How many appeals exactly can one lodge? This is the news of Malema on a daily basis 1. Malema Suspended! 2. Malema Appeals 3. Malema appeal denied 4. Malema appeals the denial of appeal 5. Malema appeal of the denial of appeal also denied 6. Malema appeals against the denial of appeal in the matter of the denial of appeal 7. Malema appeals against the denial, of the denial, of the original denial against his appeal. WTF Is it any wonder the government can't function when a suspension, handed over 6 months ago has this ridiculous process to follow. How many people have to handle this, how much tax money is spent doing so and for the love of god can someone just make this idiot just go away!!

  • Brett - 2012-04-19 15:52

Malema please read this: 1. You cannot legislate the poor into prosperity by legislating the wealthy out of prosperity. 2. What one person receives without working for, another person must work for without receiving. 3. The government cannot give to anybody anything that the government does not first take from somebody else. 4. You cannot multiply wealth by dividing it! 5. When half of the people get the idea that they do not have to work because the other half is going to take care of them, and when the other half gets the idea that it does no good to work because somebody else is going to get what they work for, that is the beginning of the end of any nation.

Malema will remain influential whether he is in the ANC or not. He will be the most talked about as those who will be failing to lead or become famous will continue to critisize him. They will keep yaping about discipline and promising you more jobs just like they always do on every speech.\r\n\r\n\r\nThey will continue to plan plan and plan, asking the planing minister to plan on how to get jobs while unemployment continue to grow.\r\n\r\nMalema is out, in the news you will only see strining people, from cosatu to communities back to miners.\r\n\r\nNo one will be coming up with MUCH NEEDED CHANGE THAT MALEMA HARDLY PUSHED. I WILL BE OUT OF THE ANC TOO AND I'M GLAD I'M NOT ALONE. Yes my vote is important and ANC NEED IT, watch upcoming elections if Malema is out and zuma continue , you will then see how important my vote is.

      John - 2012-04-20 04:35

@Collen, I asked @Florence yesterday and now I'm asking you or anybody out there...what is this r\n\r\r\\n supposed to mean? I'm ready for the ridicule, just please explain it to me.

      Collen - 2012-04-20 12:27

@john\r\nIt supposed to mean what is written there. It is an explanation itself. Florence never bothered to answer you bcos u couldn't understand yourself too.
