Washington - The Pentagon has determined that Saddam Hussein is a prisoner of war, a US defence official said on Friday, ending uncertainty about the deposed Iraqi president's legal status.
"We have determined he does have prisoner of war status," said the official, who spoke on condition of anonymity.
"There is no formal declaration. It's not required, and we haven't made one," he said.
The official said assigning Saddam prisoner of war status makes him eligible to be tried for war crimes.
