Bush's prison powers 'worrying'

2005-11-13 14:32
line

Washington - The Senate has allowed the Bush administration discretionary power to treat accused terrorists according to its wishes by withdrawing their right to appeal their detention in the civilian justice system, a move that is worrying judicial experts.

"We will have the equivalent of 'lettres de cachet'," said attorney Eugene Fidell, president of the national institute of military justice, referring to the power of French kings to send critics of the regime at will to the Bastille prison.

The Senate added to a defence department budget bill on Thursday, an amendment that would deprive non-US citizens accused of terrorism of the right to seek redress in civil courts.

Republican senator Lindsey Graham said in defence of his amendment that we should yield nothing to terrorists or to the so-called enemy combatants, a category President George W Bush has used to avoid holding irregular soldiers as prisoners of war, which would entitle them to protections under the Geneva Conventions.

Graham also stood behind a measure to ban the torture of any prisoner by US personnel, after vice president Dick Cheney lobbied congress to allow an exception for the CIA. Graham condemned alleged abuse by CIA agents in the war on terror.

"This war is about tolerance and values, respect for human rights, this war is really about character... If you don't practice what you preach... you're going to tarnish who you are," he said.

The amendment, adopted by 49-42, counters a 2004 Supreme Court decision, which established that the civilian courts were competent to hear cases of Guantanamo prisoners.

It would prevent the high court from deciding on the legality of the military tribunals put in place by the Bush administration to judge prisoners.

The Supreme Court decided last Monday to take the case of Salim Ahmed Hamdan, a former driver to Osama bin Laden and a Yemeni held at the controversial camp at Guantanamo Bay, Cuba since 2002. His lawyers have posed the most serious challenge to the Bush administration so far.

Avoid embarrassment

The amendment "is an effort to save the Bush administration from another embarrassment before the Supreme Court," said Jonathan Turley, a George Washington University law professor.

The idea of undercutting the writ of habeas corpus, which recognizes the right of a person in detention to go before a judge, has met criticism even among conservatives.

"The writ of habeas corpus is rightly considered the glory of Anglo-American common law," said a an article published in the Los Angeles Times by David Rifkin and Lee Casey, who served in Republican administrations under Ronald Reagan and George Bush, the father of the current president.

"So far judicial review of the government's detention policies has not compromised its ability to defend American interests," they wrote.

"There is great value in having the courts affirm the basic legality of the administration's approach," they said.

Turley called the senate's limitations on the justice system worrisome.

"The detainee cases have shown a great triumph of an independent judiciary. If there's one area we can point to with some pride since 9/11, it's been the willingness of judges, including Republican judges, to stand up to President Bush and say that he's wrong."

Spyker says... Israel understand the nature of the beast. Iran is simply vying for an artificial position on the global stage - a bit like Russia and South Africa. They seem to think that nuclear capability will 'buy' them such a position - ha, ha, ha... It is so overtly laughable, I would suggest that the bona fide 1st world just looks away for a week, then let Israel wipe the trash into the dustbin. Iran has NEVER contributed anything meaningful to the advancement of life on earth (much like Syria and Libya before late 2011) - its fundamental purpose has to be questioned accordingly. The biggest joke of it all = SA had full nuclear capabilities by the 1960's already. One of only five countries that could manage it at the time. This despite the fact that SA endured international sanctions - ie we managed it largely from a clean sheet, hence the reason SA has made the only meaningful nuclear power generating invention since.., well, Einstein - viz the PBMR (something that has subsequently been stolen by the USA - don't blame them, the ANC coerced the PBMR co back to the stone-age, by virtue of AA policies). Russia's economy id only the 11th largest in the world (ref IMF data) yet it is one of the five permanent members of the UN Security Council. SA has a fake position as a member of the BRIC countries - note, it is only China that recognises this 'status', even the other members of BRIC ignore this inanity; more so the international financial community.
