Israel citizenship ruling 'racist'

Jerusalem - Rights groups and parliamentarians on Thursday criticised a court ruling upholding a law that prevents Palestinians married to Arab Israelis from obtaining Israeli citizenship or residency.

"It is a dark day for the protection of human rights and for the Israeli High Court," attorneys Dan Yakir and Oded Feller from the Association for Civil Rights in Israel said in a statement.

ACRI was one of three rights groups that had appealed to the High Court over a law preventing the Palestinian spouses of Israeli citizens from obtaining either Israeli citizenship or residency.

At present, Palestinian men over 35 and women over 25 married to Israeli citizens can only obtain short-term permits to be in Israel that allow them limited permission to work, no social benefits and must be regularly renewed.

The petitioners said the law violated the right of Palestinians married to Arab-Israelis to a family life, but in a late-night ruling, the High Court said human rights could not override security concerns.

‘Racist’ law

Six judges backed the controversial law, while five were opposed.

"Human rights are not a prescription for national suicide," wrote Justice Asher Grunis, who is poised to become the next president of the court.

Yakir and Feller accused the court of stamping "its approval on a racist law, one that will harm the very texture of the lives of families whose only sin is the Palestinian blood that runs in their veins".

In July 2003, parliament adopted a law limiting the right of non-nationals to residence in the Jewish state, blocking citizenship for Palestinians married to Arab Israelis.

Initially applicable for one year, the law was extended for security reasons but has been challenged by rights groups on more than one occasion.

‘Pouring oil on fires of racism’

Arab-Israeli MP Jamal Zahalka, of the Balad party, said the court "had failed the test of justice".

"This decision will encourage the racist groups in the Knesset (parliament) to enact more anti-Arab, anti-democratic and anti-human rights laws," he warned.

"The court's ruling pours oil on the fire of racism burning in the Knesset and removes any fear that the High Court will repeal laws on grounds of unconstitutionality," he added.

Mohammed Barakeh, another Arab-Israeli politician, from the Hadash party, said the ruling was proof of a "wave of racism" sweeping across Israeli institutions.

"This law, which differentiates between people in a repulsive, racist fashion, sets standards for an individual's personal life and denies Arabs their right to choose their life partner," he said.

Adalah, which works to protect Arab-Israeli rights and was part of the appeal to the High Court, also condemned the ruling.

‘High Court failure’


"The court upheld a law that has no parallel in any democratic country in the world," the group's lawyers Hassan Jabareen and Sawsan Zaher said in a statement.

"The court has failed in its basic responsibility as a defender of the Palestinian national minority while the majority in the Knesset uses its power to affect the basic principles of democracy and particularly the rights of the Arab minority in Israel," the lawyers added.

Israeli MP Zehava Galon, a member of the left-wing Meretz party who filed her own appeal to the High Court against the law, echoed Adalah's criticism.

"The High Court has failed in its duty to defend the principle of equality of all citizens before the law and to fight against racism," she told Israeli public radio.

Judicial commentator Moshe Negbi said the court ruling compromised Israel's defining principles.

"Israel defines itself as a Jewish and democratic state. For the first time, the High Court has privileged its Jewish character to the detriment of its democratic character," he said.

    I understand Israel's security concerns, but a little compromise would go a long way. How about a probation period of, say, 5 years to see if the Palestinian spouse can 'behave', after which citizenship and residence is granted? I doubt a terrorist would fake a marriage for 5 years just to bomb a bus stop.

      This entire argument completely misses the point, if a terrorist wants to bomb a bus stop in Israel the last thing he/she need to do is pretend anything, They have never had that much trouble getting over the border in the past, why would it stop them now. The bottom line is inequality and the apartheid status of Israel, very few Jews currently even having a descendant connection to the middle east, and the US's unilateral theft of the land given to the Jews in the first place. If 1% of the current Jewish population in Israel can prove any relation to the sons of Abraham I would be very surprised, The European Jew being the descendant of the Khazar people who converted to the Jewish faith, but were never birthright Jew's.

      When you were still a twinkle in your fathers eye, I was a critic on campus of the old system. With the benefit of hindsight, I was, in many cases wrong.If apartheid was introduced to prevent the prevailing chaos and the imminent collapse of the country, then it was justified- and I say that as a staunch critic, then. However, I am not blind, and right now, I am also a critic of the present regime. I was/ am disadvantaged on both sides of 94.My children are abroad and thankfully, I do have options.But I certainly do not hate people, including blacks and arabs. I do not suck my thumbs- I worked in that area. Responding with insults, in the absence of a sensible answer is really not advisable.

    No-one forbids Israeli citizens to marry other Israeli citizens, regardless of race, ethnicity or whatever, and live together in Israel. Also, in stark contrast to e.g. Egypt and Lebanon, which even revoke citizenship of their citizens if they marry Israelis (even Israeli Arabs), Israel does not punish its own citizens for marrying whomever they want. The only thing Israel prevents is import of enemy agents through marriage from entities which wage war on it. BTW. similar "bride import" laws also exist in Denmark...     It is quite right that Palestinians married to Arab Israelis have no right to Israeli citizenship. That would be national suicide. Look at the mess in Europe and England. A Frenchman is no longer a Frenchman in much the same way that an Englishman has lost his identity as well. Does an Israeli lass married to an Englishman Iranian have the right to Iranian citizenship? I believe there is not one simply because their marriage and culture shall be a stench in the Iranian nostrils.

Who are the Jews, that puts them above the rules that dictate how the rest of the world is expected to act, Does their status as "Gods people" make them any better than the rest of humanity, or exempt them from the laws of decency and brotherly love the rest of us try to conform to? As for breeding the Israeli out, the Chinese stated in the 1960's that they would take over the world using a quiet revolution from within, does this mean we must kick all the Chinese out of our countries because they could get strong enough to influence the vote? The last word here is that it is impossible to breed out the Israeli, as the Jews who inherited Israel were not the sons of Abraham they claimed to be in the first place, no matter how much they would like us to believe it.

    Where is the apartheid in denying citizenship rights to foreign people? Every country does that. You may not scream unfair until you have looked at the specific cases, nor is it fair to make accusations of racism unless you know all the facts. From what I understand there is very little or no racial distinction between Jews, Lebanese, or Syrians. I don't think they are even as distinct to one another as Khoi-San from their Bantu speaking neighbours. The real difference is religious and cultural. Pan-Arab nationalism has tried to make people believe in a distinct Palestinian ethnicity in order to control the entire Middle East. If people throw bombs at you, you must strike back. Every nation does that, and every nation keeps hostile neighbours at bay, as is its right to do. Trying to remove the right of a particular ethnic group to defend itself and its territory and questioning its every move and its authenticity is nothing short of racist. That is what the western media seems to be doing to Jews, inside of Israel and elsewhere.

I imagine they would be in the courts protesting saying its unreasonable they should swear loyalty to Israel because of the war etc. This bill doesn't discriminate against arabs it discriminates against palestinians demanding Israeli citizenship

What we should do then, in your opinion, is round up all the American, English, French, Swedish, etc. blacks and deport them from those countries back to Africa.     Will Israelis be given similar rights in Lebanon, Palastine, Gaza strip, Saudi Arabia or any other muslim country if they marry a citizen of that country. It amazes me how racism only works one way.

    Israel is of course the last indisputable champion of apartheid, but as the US is run by Jewish money they would never dream of imposing sanctions. Isn't it time for the American people, who I have found to be one of the most helpful and friendly nations on earth, to stand up to the abomination that their government has become? I urge every American Patriot to stand up to your government before you are stripped of what little power you have left. and for the record Patriotism is loyalty to country not government.
