Jail threat over Muslim burqa

Sydney - Australian authorities on Friday said motorists who refused to take off face-covering veils such as the burqa when asked to do so by police could be sent to jail for up to a year.

Under the changes to laws in New South Wales state, police will be able to ask drivers to remove helmets, masks, the face-covering niqab veil and the all-body garment the burqa.

Refusal to do so would incur a fine of A$220 ($228), but in the most serious cases could result in up to a year in jail and a fine of A$5 500.

"People will only be required to remove a face covering for as long as it takes to identify them," New South Wales state Premier Barry O'Farrell said.

"Those who want to be identified privately for cultural and religious reasons can request to go to a police station."


The changes, to be introduced to parliament next week, will also give officials the power to request the removal of face coverings in courts while visitors to prison could also be asked to remove any coverings that obscure their identity. Those who refuse could be fined up to $550.

"I have every respect for different religions and beliefs but when it comes to enforcing the law, the police should be given adequate powers to make a clear identification," O'Farrell said in a statement.

The change follows the recent case of a Muslim woman being acquitted when a magistrate ruled she could not be positively identified because was wearing a burqa.

In the high-profile case, Sydney woman Carnita Matthews was sentenced to six months in jail in November 2010 for falsely accusing a police officer of forcibly trying to remove her burqa.

But her sentence was later quashed after a magistrate said he could not be 100% sure it was Matthews who later walked into a police station to make the complaint because officers were not able to see the face of the accuser.

Police already have the power to ask women to remove face veils during the investigation of serious offences, but not on more routine matters.

The wearing of full-face niqab veils by some Muslim women has become a contentious issue in parts of Europe, where France has banned them in public.

The New South Wales state ombudsman will review the new laws after they have been in place for a year.

    Excellent, burquas are not a religious requirement, they are cultural and immigrants should respect the culture of their adopted country and fit in otherwise stay in the country of your birth. Imagine what would happen if a female walked around in shorts and a skimpy top in a muslim country, they would quickly be put in jail, you cant even hold your wife's hand without being fined. Try complaining... they dont care.. it is a case of "fit in or f.. off". What right have they got to complain when they go against the norm in Western countries and are told to comply with the way things are done there?

      Yes, I know that for many Muslim women, the wearing of burqa or face cover is voluntary and not forced upon them. However, it IS FORCED ON MANY! Or have you not heard about the "morality police" in countries such as Iran, Saudi, Afghanistan, and so forth, who beat women in the streets because they don't have a face covering?       Dupsie: The point is that if a Westerner wishes to live in an Islamic country, then they need to strictly adhere to the laws of that country otherwise they face jail and other harsher sentences. Why, in that case should Western countries not insist that the same is true if a Muslim wishes to reside in one. For too long has the West been too accepting of other religions. It doesn't say ANYWHERE that she must cover her face so that only her eyes show. The clearest verse on the requirement of the hijab is surah 24:30-31, asking women to draw their khimar over their bosoms: "And say to the believing women that they should lower their gaze and guard their modesty; that they should not display their beauty and ornaments except what appear thereof; that they should draw their khimar over their bosoms and not display their beauty except to [...] [Qur'an 24:31] The wives of the Prophet were the only ones required to cover their faces so that men would not think of them in sexual terms since they were the "Mothers of the Believers," but this requirement was not extended to other women. The following is a Tradition of the Prophet: "Ayesha reported that Asmaa the daughter of Abu Bakr came to the Messenger of Allah while wearing thin clothing. He approached her and said: 'O Asmaa! When a girl reaches the menstrual age, it is not proper that anything should remain exposed except this and this. He pointed to the face and hands." (Abu Dawood) So perhaps you should study your qu'ran some more?

    I am a proud Muslim woman who dresses modestly and covers my face…and contrary to the popular belief I was not forced to do so by any single person for luckily living in South Africa I have this freedom of choice. I am a professional woman with a degree, yet I have given this up to stay at home and live an Islamic life. A decision which I will never regret. I believe to criticize other religions one must research and gain a full knowledge of everything it entails and sadly most people believe that it is enough to just use google. I agree with absolutely nothing that Christianity offers yet I will refuse to rebuke this religion for respect of its followers. This world is a test, it is the greatest test that God has given to his servants. If one examines it closely, irrespective of the religion followed…the world is a temporary space. Why should I, as a Muslim woman, try to fit into the world if I know my reward will be far much greater in the hereafter than anything that your acceptance of me could possibly offer? I believe that yes if a law such as this comes into place Muslims have no choice but to follow but one must always remember the mercy and power of Allah.

      I believe in a God with no partners. I believe in His book, the Quraan. Christians seem to be confused as to whether Jesus is God or just the son of God. My God needs no sons. And I believe in the Quraan which unlike the Bible does not need to be changed and had never been changed by humans.Please do not quote the Quraan out of context.

As for the koran being "unchanged" - have you heard of the Yemeni manuscript? Have you heard of variant readings of the koran? Have you heard of the differing manuscripts that were burnt in order to come up with one version? Have you, have you, have you... I take it not. Have you actually done a proper research into comparisons between the current Bible and the ancient manuscripts? We have over 20 000 ancient Biblical manuscripts- they match our Bible today. I have no doubt that this little fact escaped you and your imams...

    I find it amazing that God, Yahweh, Allah "need" all these defenders of the faith. Seriously, if whichever deity is as all powerful as their adherents believe and say, they why to they take it upon themselves to " chastise the infidel, non believer, apostate, blasphemer etc. One would think ( trying to be rational here) that if the deity with all these powers were offended, or hated the goings on all over this world that He/ She/ It would mete out the justice/devastation/smiting required. Personally I think whomever decides that they must protect their God's teachings by attacking or killing others are the epitome of essence they are playing God/Allah/Yahweh and by doing so show their own lack of understanding of any of these faiths.

    I think this is what all states should do or apply in order to fight crime and terrorism, because most terrorists hide themselves in those clothes and at the end made the name of Muslims bad by their actions. So due to increasing world terrorism threats then people should stop wearing face covers even women, for security reasons for the entire earth to be save from terrorists and dangerous criminals.

    Agreed with the Aussie law; nothing wrong with it. What I don't agree with is the hatred that is so prevalent in these comments. All you need is an article like this to spark of your true colours. The issue is one of security; it is not a religious requirement and the NSW Police have offered people that have an objection to go the Police Station and have the facial covering removed for identification purposes. So why the hate speech?
