Teen faces lashing for pre-marital sex

Male - A court in the Maldives has ordered a public flogging for a 16-year-old girl who confessed to having pre-marital sex, defying UN pressure to drop corporal punishment of women, officials said on Tuesday.

The unnamed teenager was convicted on her confession under sharia law after her family complained that she had sex with a 29-year-old man in July.

The man was given 10 years in jail during a court hearing in the remote Raa atoll on Sunday.

A court official said the girl, whose identity was not revealed, could refuse the public flogging and would then instead be subjected only to eight months house arrest under local laws.

The court ordered the lashing to be carried out when she reached the age of 18.

"In most cases, the offenders would accept the lashing as part of penance," a court official who declined to be named said.

Sex with a minor


The latest court ruling came 10 months after UN Human Rights chief Navi Pillay urged the Maldives to stop publicly flogging women for having extra-marital or pre-marital sex.

Pillay noted during a visit to the country that the Maldives had progressed in safeguarding the rights of its 330 000 Sunni Muslims, but more needed to be done to protect women.

Flogging is normally handed down as a punishment by village chiefs who also act as local judges. A cane is used.

Official sources said the girl had been tried under sharia law, which prohibits girls between the ages of 13 and 18 years old having pre-marital sex. The conviction was on the basis of her confession.

Her lover, on the other hand, had been tried under common law and convicted for having sex with a minor, an offence punishable with a sentence of up to 15 years in jail.

The pair had intercourse in the Raa atoll, about 200km north of the capital island Male.

The Maldives, better known as a luxury tourist destination, adopted multi-party democracy in 2008, but faced political unrest leading to the resignation of the first elected president, Mohamed Nasheed, in February.

      I'm a muslim and I'm deeply offended my your comments.sharial laws is not extreme if carried out correctly.certain muslim countries ammend shariah law to suit their needs so don't you dare label all of us bad.sharial law is meant to protect not harm.now more than ever I'm going to do study post-grad diploma in islamic studies to educate ignorant people like yourself.

      @Khalida It's your choice to be offended, stating it makes no difference. You have no right to not be offended. Your argument invalidates itself. If the incorrect application of shariah law is down to interpretation, then how are you so certain that your interpretation is the correct one? Especially since you need to study further to provide a simple rebuttal in a News24 comments section. You are going to do a post grad diploma to educate the ignorant? Sounds like you've made up your mind before you've even done the studying. That's the epitome of ignorance.

      Which part of this do you find crasy Hemlock/Captian?? Honestly ???? has your upbringing been so sick and retarded that you find it acceptable for a Guy to have sex with a minor? Or that a MINOR girl should have sex with the risk of contracting Aids? unwanted pregnancy's and who knows what other horrors? What is so wrong with that ruling? Is this so bad? But hay for people like you its fine for them, not to drive a car as a minor but go ahead have a baby! The only thing brainwashed here is your sick self. I wonder though if your view would have changed if your MINOR daughter had slept with a guy, contracted aids, had a baby , died and YOU had to foot the bill and care for her child.       This is not about a single issue, but the fact that Islamic societies are so sexually suppressed, that young men are willing to martyr themselves as suicide bombers based on the promise of a bit of nookie in paradise - 70 bits of nookie, nogal. Sharia belongs in the fifteenth century and has no place in this modern world. Morality is successfully taught by ones parents and religion may not have a say. Sharia will be exterminated.

Khalidah, if you're offended, tough luck! Start off by having a good hard look at your religion, then you'll realise why the rest of the world hates Islam. I hate all religion, but Islam is even worse than Christianity.

But one thing i still confused with it is that does sharia law protects women from being used as unvaluable human being, knowing that STD diseases, like HIV aids rates is less than 0.01 in muslim world compared to other countries.

    Note that sex with a minor is statutory rape....10 years is not excessive. And the girl getting punished is not so bad...how many parents would not have either grounded their teen daughters or smacked them for this? 8 months of house arrest might ctually do the young lass a world of good...help her control those hormones...

    This is extreme and arcaic! Flog the 29 year old man who should know better and leave it at that. And 10 years in jail seems completely extreme if the union was concentual. We are sexual beings and harsh punnishment for natural urges is ridiculous!

    When comparing with previous stories regarding Sharia law I do not think this is too heavy on the girl. She can also choose the 8 months. The man got a bit of a bad deal but being an adult he should have known and he will most probably get off on the sentence while serving it?(is it like that?) What is good is that in this case the man was also punish and not only the girl. I presume this community lives in a way that they all know the rules and it works for them. We may not understand the problems and the contexts of that country/people and maybe this works for them. I categorically(Hi oom FW) needs to state that my comment is ONLY based on this case and not approving the whole Saria law. I heard bad things, but cant comment because I don't know it. Even that it seams that some people misuse it.

    Rather have this sever punishment than dealing with unwanted teenage pregnancies, abortions, HIV, Aids an exhausted social grant system that is a burden on the tax payer. Think carefully before criticising why Islam, Christianity and Judaism has strict laws regarding fornication and adultery. The ramifications and the burden on Society as a whole are worse. Statistically, not many floggings take place due to the severe punishment that acts as a deterent.
