Judge rules on whether Joost gets trust fund money back

The judge made his decision this morning, after deeming the situation "a case of life and death" for Joost.

Joost van der Westhuizen is to be paid R385 665 plus his legal costs by the Attorneys Fidelity Fund.

Judge Lester Adams ruled in Joost's favour in the Pretoria High Court on Wednesday.

The ruling comes after the former Bok caption took legal action against his business partner and attorney, Robert Klinkenberg, claiming he embezzled the money.

Joost alleged he gave the money to Robert, the director of Klinkenberg Incorporated, to keep in a trust so he could easily access to money to cover mounting medical expenses.

The Attorneys Fidelity Fund disputed Joost's application, arguing Klinkenberg did not steal the money from the rugby star, so it should be recovered from his former lawyer's estate.

The father of two now has to be cared for day and night. He has suffered from incurable motor neurone disease since 2011 and although there’s nothing wrong with his mind, he’s confined to a wheelchair.

His carer has to help him every time he wants to swallow because his neck muscles are too weak to hold his head up.

On Tuesday Netwerk24 tweeted from the court that the judge had found that Joost’s application was indeed a “case of life and death” and urgent, as Joost’s legal team had maintained.
