Nel didn't infringe on Oscar's human rights, SAHRC rules

The South African Human Rights Commission has rejected the complaint made against Advocate Gerrie Nel, the prosecutor in the Oscar Pistorius murder trial.

The South African Human Rights Commission has rejected the complaint made against Advocate Gerrie Nel, the prosecutor in the Oscar Pistorius murder trial.

In a statement the commission says a complaint was laid last Friday requesting an investigation of whether Gerrie should be allowed to refer to Oscar as a liar during Oscar’s testimony in court GD of the High Court in Pretoria.

The complainant alleged that Oscar’s right to innocence until proven guilty, his right to freedom of speech and human dignity and his right to a fair trial had been compromised.

Since the complaint was laid the commission has received other complaints in connection with the Oscar trial.

After careful consideration of the complaint within the context of the basic right to a fair trial in the constitution, the facts of the case, international conventions, the bar council’s rules, the commission’s jurisdiction and the authority of the court, the complaint was rejected.
