Angie’s looking for physical custody of her and Brad’s brood, but what does that mean exactly?

The news that the celeb power-couple Angelina Jolie and Brad Pitt are parting ways after more than a decade together has sent shockwaves all over the world.

Not only is the Hollywood romance – which apparently first heated up in 2004 when the pair worked together on the movie Mr and Mrs Smith – over, but Angelina also wants physical custody of the couples six children. She asked that Brad get visitation rights and share custody.

The children will live with the parent who has physical custody, and provided Angie gets what she wants, her brood will live with her. Because Brad will have shared custody rights he will also have a say in important decisions regarding the children. He will also have visitation rights, should the court grant Angie’s request.

Although South African legislation differs from American legislation the basic laws regarding custody are similar, says Sheri Breslaw, a family lawyer from Cape Town.

“Physical custody means the kids will live with her, but Brad will have equal say in important issues regarding them like their religion or schools.”
