Amcu case struck off urgent roll

The Association of Mineworkers and Construction Union’s attempt to stop platinum companies from directly negotiating with employees has been struck off the urgent labour court roll.

The case was struck off for lack of urgency and not on merits, said Amcu representative Jayson Kent at court today.

Amcu was seeking an order that would stop Lonmin, Anglo American Platinum (Amplats) and Impala Platinum’s expansive campaigns to poll employees on their willingness to accept the standing offers and break the strike.

Apart from Impala, the companies had effectively been bargaining with employees around the union – something Amcu argued contravened their recognition agreements with the union.

The court application has to some extent been overtaken by events. First labour court judge Hilary Rabkin-Naicker convinced Amcu and the companies to undergo a new round of mediation.

Then, with the appointment of South Africa’s new Cabinet, the new minister of mineral resources, Ngoako Ramatlhodi, announced another process to help along an agreement between Amcu and the mines.
