Anti-Semitic Facebook post unconstitutional

The South African Human Rights Commission has urged the public to use social networking sites responsibly.

This came after the commission resolved a case involving a man who made anti-Semitic statements.

In July, Ziyaad Kayat sent a message to the South African Jewish Board of Deputies on their Facebook page.

“All Jews are pigs and I think we should kill you SA Jews and kill your kids and let you feel what the Palestinians are feeling,” he wrote.

The board laid a complaint with the human rights commission, which found that Kayat’s comments were in contravention of, among other laws, Section 16 of the Constitution, which prohibits expression that incites violence or advocates hatred based on religion or ethnicity and constitutes incitement to cause harm.

After the commission approached Kayat, he signed an unequivocal apology to the board, the commission and the South African public.

“In this apology, Kayat retracted the comments and acknowledged the comments were wrong and uncalled for. He expressed his commitment to the Constitution,” said the human rights commission today.

The board accepted the apology last week.
