Attorney sues over alleged racial insult

An attorney in Mthatha is suing the Eastern Cape Education MEC Mandla Makupula and a pupil for R500 000 over an alleged racial insult.

Makupula is former headmaster of Queens College.

The Times newspaper reported the attorney alleges that a pupil at Queens College called his son a “k****r” at the Whitson Hostel.

According to the report, the college announced that it had dealt with the matter and in terms of the college’s code of conduct, the censure was 10 demerit points.

The attorney is unhappy with the sanction for what he described as “criminal offence of crimen injuria”.

He took it up with the province’s superintendent-general of education and in court papers he listed attempts made to raise the alleged racial insult with the South African Human Rights Commission.

He claimed that former principal Chris Harker had told the commission that they had dealt with the matter and that the boy had apologised to his son.

The attorney said he had struggled to get a copy of the school’s code of conduct and had not yet received any documents relating to the school’s disciplinary proceedings over the matter.

The province’s department of education said it would fight the lawsuit.
