Blow for Pistorius in bail application

The Oscar Pistorius case will be regarded as a Schedule 6 offence for the purposes of his bail application.

As a result, Pistorius’ defence team will have to show that exceptional circumstances exist that warrant his release on bail.

Chief Magistrate Desmond Nair said he was “perplexed” as to why his job wasn’t made easier by the State, which could have obtained a certificate from the Director of Public Prosecutions to recommend the schedule of the offence.

He said he could not rule out premeditation and would hear the matter as a Schedule 6 offence. The schedule may change depending on the evidence led, legal reporter Karyn Maughan tweeted.

Pistorius bowed his head and started crying upon hearing the news, Jacques Steenkamp reports.
