Court orders Pamodzi enquiry

The Pretoria High Court had ordered an enquiry into the affairs of the liquidated Pamodzi companies in terms of sections 417 and 418 of the Companies Act, the provisional liquidators of the companies said.

The scope of the enquiry is to include an investigation into the conduct of Aurora Empowerment Systems when it was in charge of Pamodzi Gold’s mines in Grootvlei, Springs, in Gauteng, and Orkney in North West.

Aurora has been accused of the destruction of infrastructure at the mines and the loss of more than 5 300 jobs.

It was singled out as the preferred bidder for Pamodzi’s mines when they went into liquidation in 2009, but has since had its management contract cancelled.

The joint provisional liquidators said the enquiry is to be held in camera.

In terms of the Companies Act, only the court had the power to determine that it should be conducted in public.

Witnesses who have been summoned to appear before the enquiry include the directors of Aurora – President Jacob Zuma’s attorney Michael Hulley and his nephew Khulubuse Zuma, former president Nelson Mandela’s grandson Zondwa Mandela and Thulani Ngubani, the company’s commercial director.
