Court throws out mine rights appeal against Kumba

Kumba Iron Ore, a unit of Anglo American, said the Supreme Court of Appeals had dismissed an appeal by the mining ministry and Imperial Crown Trading (ICT) against the mineral rights it holds at its Sishen mine.

Kumba said this meant its Sishen unit had “the exclusive right to mine iron ore” at the mine, Africa’s largest iron ore mine.

The rights dispute between Kumba and ICT has also featured in the disciplinary hearing of prosecutor Glynnis Breytenbach, who was suspended by the National Prosecuting Authority in April last year for allegedly having an unprofessional relationship with Advocate Mike Hellens.

Hellens, a member of the Johannesburg Bar Council, represents Kumba Iron Ore’s interests in the company’s dispute with politically connected ICT.
