Freak accident puts man in hospital

2010-05-12 13:15

A generator put a 36-year-old man in hospital this morning.

Paramedics believe the man, a pedestrian, was hit by the exhaust pipe of a

generator that was hanging from a truck as it passed him on Pretoria Road in

Kempton Park.

Chris Botha, spokesperson for Netcare 911 said: “The man was

unconscious when we arrived. We had to put him on a ventilator.”

The man’s identity is still unknown. He had extensive injuries to

the head and needed to be assisted to breathe. A Netcare helicopter with a

trauma doctor on board was called to the scene to help stabilise the 36-year-old. He is fighting for his life in the Charlotte Maxeke Hospital, where he is

receiving specialised treatment.

Botha said they were investigating where the truck was from.

Asked whether the victim would have grounds for a claim in this case, Maria Davey from Meumann White Attorneys said while it was difficult to say, the incident could have resulted from negligence. She said it would have to be determined how the generator had been secured to the truck, what the

visibility of the exhaust was and where the pedestrian was standing at the time of

the incident.

“If the truck driver was acting in the course and scope

of his employment and he was negligent, then his employer could be held

vicariously liable,” she said.
