Girl (17) added to register of sex offenders

The name of a 17-year-old Welkom school girl has become the latest addition to the national register of sex offenders, although a decision has not yet been reached on whether this is constitutional.

The Centre for Child Law at the University of Pretoria stressed in a statement how serious the consequences are if a child’s name is included in the register.

“The girl will never be able to have a career in which she could come into contact with children.

“She will never be allowed to apply for her name to be removed from the register,” said the statement.

The centre is concerned that the girl was not aware of the implications of her name appearing in the register when she signed a plea bargain.

A suspended sentence of three years was imposed on the pregnant girl last week after she pleaded guilty to charges of producing and distributing child pornography.

Judgment is pending in a Constitutional Court case to have a section in the Amendment Act on sex offenders declared unconstitutional. This section provides that the offender’s name should be included in the register without him or her having the opportunity to speak to the court about it.

A 14-year-old who was found guilty on three charges of the rape of boys approached this court to have the section declared unconstitutional.
