Malala ruling to be appealed

 A ruling that presenter Justice Malala did not violate the broadcasting code by describing President Jacob Zuma as “loser of the week” will be challenged, the complainant said today.

Cunningham Ngcukana said the panel of the Broadcasting Complaints Commission of South Africa which dealt with the matter was biased and had prejudged the matter.

He took issue with Malala’s regular “loser of the week” feature on the analysis programme “The Justice Factor”, saying that the code required that comment should be an honest expression of opinion, based on facts.

Malala based his nomination of Zuma on the president’s call for the lifting of sanctions against Zimbabwe.

The commission found this week that the right to freedom of expression permitted journalists to rate politicians, even though not everyone would agree with the results.

It felt Malala’s comments amounted to an honest expression of opinion and were presented in such a manner, made on facts fairly indicated.
