Malema team applies for appeal reinstatement

An application by ANC Youth League president Julius Malema’s legal team to reinstate an appeal against a hate speech finding on his “nice time” rape remark, will take place sometime next month, a lawyer said today.

The Sonke Gender Justice Network secured a hate speech ruling against Malema from the Equality Court after he said that a woman who had accused President Jacob Zuma of rape had “a nice time” and had breakfast afterwards.

The network’s lawyer, Chris Todd, said today that the application had been postponed by the High Court in Johannesburg for a date to be set some time after March 8.

Malema was ordered to apologise for the remark and pay the network R50 000 to the network, but indicated he would not, pending the appeal.

In his election campaign in 2009, Malema said: “When a woman didn’t enjoy it, she leaves early in the morning.

Those who had a nice time will wait until the sun comes out, request breakfast and ask for taxi money.”

During the Equality Court hearing it was submitted by Malema’s attorney that he was recalling sections of the judgment which acquitted Zuma of rape.

However, the network said this was incorrect, as Malema’s account was not in accordance with the account in the judgment.
