Man who called domestic worker the k-word waits to hear his fate

2015-01-28 11:48

The sentencing of a man who called his ex-girlfriend’s domestic worker a “k*ffir” has been postponed.

André van Deventer (36) sat next to 50-year-old Gloria Kente outside the Cape Town Magistrates’ Court after hearing that Magistrate Alta le Roux was ill.

They did not speak to each other and Kente said she was frustrated at yet another postponement.

Another magistrate soon entered the courtroom and postponed Van Deventer’s sentencing to next Friday, February 6.

The matter had previously been postponed to allow the correctional services department to write a report. The court heard today that this report was ready and had been handed to the state and defence.

At the end of last year, Van Deventer was found guilty of assaulting Kente and spitting in her face at the Table View, Cape Town, home he shared with his then girlfriend Mariechin Pienaar in 2013.

Kente previously told the court he grabbed her pyjamas, verbally assaulted her and spat in her face.

He admitted to the crimen injuria charge, but denied assaulting her.

Prosecutor Andy Hess previously told the court an appropriate sentence would be house arrest, community service, and a prohibition on using alcohol or any drugs.

Correctional services would set out the appropriate programmes for him.

The recommended sentence was in accordance with section 276 (1)(h) of the Criminal Procedure Act, which offered correctional supervision after a correctional officer had placed a report before the court. The supervision could not exceed three years.
